Hi there, hope I could find answers here.

Me and my fiance is wondering if we really need an immigration attorney or not. Cause his concerned is that, he don't want to take risks by doing it ourselves, since I filed a tourist visa before and unfortunately I got denied (Im from PI by the way), and he is worried that if we filed this K1 visa on our own I might be deny again.

And also, I have 3 kids who are all minors, and we are planning to bring them all after our marriage since they are still in school. Question is, do we need to file the k2 visa together with the k1 visa?

No you don't need a lawyer you can do it yourself. The tourist visa denial have nothing to do with the K-1 unless the denial was because of misrepresentation.

 

No, I you don't want the kids to come now then there is no reason to file a K-2 visa now. BUT you do have to mention all of them on the I-129F application.

You don't need a lawyer, unless there are circumstances related to drug use or criminal record that you haven't disclosed here.

 

All you need to do for now is mention the children on the i129f application. If you decide you will want to bring them immediately anyway, you will be able to file K2's once the case reaches the consulate. You can also do a follow-to-join K2 application if you want to bring the children within a year of the K1 visa issuance. If not, you'll have to start over with a i130 petition for each of them.

If it isn't difficult, it isn't worth it.

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens
