I don't think so, even if it's considered a cimt it should be covered by a petty exemption

Thank you for your reply I meant to put extinguished .

I figured it happens.  I'd consult a lawyer just to be on the safe side

They kept his passport though I'm wondering if that's a good sign , also on the form they gave him there was the option where the council could had asked for a waiver but she put that she wanted to see court papers . I'm lost and very stressed out

Oh I see you're at that point.  Yes it's a good sign.  Make sure your fiancé gets both court papers and if possible the arrest report translated if needed with court seal

Yeah because the first police report he got he came out clean but then thebembassy another more detailed one and on that one a petty theft robbery charge he had 2 years ago came up and at the time of the interview that was the reason why they couldn't make a decision . I was reading about the waivers but I wonder if those are for more severe cases . My fiancé was arrested but he didn't do no time and they even cancel his community service that he was suppose to do .

I don't know if I should have the papers translated , they didn't mention about having them translated plus I think that will take some time . The country is a Spanish speaking country I wonder if they would required to have them translated

It's always best to have them translated just in case.  If he feels confident to do so himself he may

Is there a website that offers translations even if I have to pay ... I speak fluent English but I don't feel comfortable translating court documents due to the different type of words and grammar they use

It doesn't need to be translated. ConOff in Costa Rica are required to speak Spanish (we get sent for 6 months of Spanish training). They also surely have some Costa Rican lawyers working in the consulate.

If they want it translated they'll ask for a translation.
