I posted about whether to file the 2 or 12 page I-130. I filed the longer one, with the two biographical forms. I just read about a new I-130A form ... was this supposed to be in our packet? I did not see it on the instructions!

If you used the newer form, then the I-130A was supposed to have been included with it.

June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

December 8, 2010: Wedding date set; it will be on February 18, 2011!

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Oh, that's not good. I suppose I'll call in the morning. We switched out the new form for the old form at the last minute.

We went over and over the instructions for hours and I have no idea how we missed this. Has anyone seen or encountered a situation like this here? I really don't want to delay our case. Does anyone have information on how to submit a missing form ideally before it causes a delay?

Thanks, I was planning on calling USCIS in the morning. I know we all want speedy processing, so of course I want to go by the lowest chance of delays. Does a RFE cause significant delays? I'm really hoping whoever I speak with is knowledgeable and can help. Barring that, we originally did the two page and the obsolete biographical forms with two passport photos each. I have a glimmer of hope they'll extend the I-130 grace period to the I-130A and accept the old bio forms instead of the new one.

 

My poor husband is going to wake up to one "WOO HOO WE HAVE A NOA" and a "OMG WE EFFED UP" email and not know what to think. Agh, I hope we get this resolved because I do not do well with nerves. :( Also we've been together 11 years this November and I thought I'd be able to do processing standing on my head but I've found that since we got married I'm tolerating the separation much more poorly. Sorry, just venting. This is so odd to me because we were so good at long distance and now I have to sleep on the couch because our bed is cold :(

The RFE delays are generally about a month.

At least your case was assigned to the Texas Service Center. That center is probably the fastest one at processing.

I really hope this doesn't cause a problem. I'm even afraid to call because I don't want to highlight the error. I'm hoping the grace period for old forms extends to the I-130A since we included what I believe are the old versions of those forms.

Update! I was the first caller this morning and I spoke with the nicest, most helpful USCIS CSR. She said that if I was missing a form, the packet wouldn't have been accepted. She also offered to look up the latest possible processing times and told me if it went past my priority date, to do something specific online to circumvent more waiting. It was such a major relief!

I hate to burst your bubble but CSR's who answer the phone for USCIS are notorious for giving out bad information if they are presented with a question that cannot be answered by the script they have.  I've seen this line called the misinformation line on VJ many times over because of this.

 

Furthermore, all the priority date means for a spouse of a US Citizen case is the date that your file officially enters the queue; nothing more (priority dates are more relevant for visa cases that are subjected to numerical limitation).

 

Lastly, expect to receive an RFE for the I-130A at the very least; an improperly submitted packet is grounds for denial but it's unlikely to come to that (i.e. you will receive an RFE for the I-130A and submit it at that time).  Trying to send anything at this point will likely be nothing more than an exercise in futility as it is highly unlikely anything you send will be matched with the file.
