Hello everyone,

 

My wife has recently naturalized and became a U.S. Citizen.  We're now getting the proper things together for her to file form I-130 for her mother and father.  I have several questions, and i hope that it can be answered here.  My wife's family is currently living in China.  She would like for her parents along with her brother to make the move to the United States.  Her brother is 17 years old and still in high school.  Can we petition for her sibling to come to the United States?  

 

In regards to form I-130.  Do I have to fill out multiple forms for her mother and father and pay the filling fee twice? And the younger brother?

 

P.S.  What type of information, (evidence should we include with form I-130) do we include when we finalize the application?

After doing additional research. After filling out form i-130, the sibling will be given a fourth preference, which would put them on a a waiting list of up to 13+ years.  Should we fill out a i-130 for the sibling? Separately, once my spouses parent's come to the United States, they can apply for their son to come to the U.S. I'm just worried that he's 17 years old now and won't meet the requirements of "children under 21."

each person needs thier own i130.

she can file for her brother but it will be a long time before he will get here. a better bet will be to just file for the parents then as soon as they get here they file for him. it will be about a 2 years he would wait instead of the 13 if she filed for him.

 

if parents file he is f2b about 2 years

if siblings file it is f4 that's 13 years

Thanks for the reply.  Her brother is turning 17 years old in October 2017.  Let's say we apply two form I-130's for mother and father.  Once they get here, they apply for their son.  Would they account for the age of the child at the time of the application or the approval?  We're worried because the law for 2 years to get him here are for "children under 21."

my bad

he will be f2a (2 year wait) while under 21 then switch to f2b (7 year wait) after he is over. either way it is faster for the parents to file and he must remain unmarried the entire time or else he will need his parents to become citizens to apply for him. I forget what it is called but there is a mechanism to retain f2a status after aging out.

Do you know the mechanism for aging out?  Also, in regards to filing the I-130.  We decided to apply for the mother, father and brother (just to get his name in line).  I assume each needs an individual form and separate payment.  What type of supporting documentation is needed?

 

For the mother, we need to send a copy of my wife's birth certificate with her mothers name on it. Do we need anything else?

 

For the father, we need to send a copy of my wife's birth certificate with her mothers and fathers name on it.  Do we need anything else?

 

For the brother, we need a copy of both my wife's birth certificate and her brothers birth certificate with their mothers name on it.  Do we need anything else?

 

When the documentation is put together and the forms are filled out.  Can we mail all the applications together?

Hello,

 

My wife who just naturalized as a U.S. Citizen's is in the process of filing two form I-130's for her mother and father.  She has a younger brother who turns 17 in Oct 2017.  Hopefully, once the applications for her mother and father get approved and they get here, they can apply for her young brother to come here.  

 

My question is, let's say my once my mother in-law comes here, her son is 19-20 and submits an application for him to come to the U.S.  The age limit for "children under 21" and the wait is generally two years for approval.  If he turns 21 any time during the application process.  Would he or wouldn't he be denied on the application?

 

Thank you in advance.  The wife and I are very worried.

  The current proposed immigration reform would eliminate the classes for siblings and adult children entirely and limit parents to a renewable visa instead of a green card that would increase the petitioners responsibility for support.   Such things historically tend to drag out so it may not happen . If it does it will change what could happen. 

This will not be over quickly. You will not enjoy this.
