Hello everyone,

I am a green card holder and I have a misdemeanor dismissed recently, it was my first offense . I should to apply the naturalization this year 2017. My worrying is if I have to wait 5 years after the crime.

I am very grateful for your advices. I was charged for a simple assault (6 months probation and 48 hours community service) for fighting with somebody.

Timeline

Depends on what the issue was. They will evaluate this under good moral character clause. Better to get advice from an immigration lawyer how they feel about it. Also use the advanced search, maybe someone in the past had a similar issue and shared how it affected his/her naturalization application in detail.

Regardless, a "petty offense exemption" may be in play

35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship

how long was it? 

did you complete your probation ? 

were you arrested?

I personally would not worry about it too much if it is dismissed. Just get all the related paperwork, include in your application.

Good luck Kobbar.  I think you will have no problems.  Just don't fight with the USCIS interviewer or punch him on the nose.
