Hi

in Item 18b in part 6 of the form i864,its written ;

(Optional) I have attached photocopies or transcripts of my Federal income tax returns for my second and third most recent tax years.

is it a problem if we can't provide the second and the third tax year ? can we leave it blank and not chose it ? 

can the uscis send an RFE just asking for the second and 3rd tax year ?

They can if they want to.

You could attach something to state/show why you don't have the tax returns from those years perhaps to explain it and avoid getting asked later.

It says it's optional so you only have to provide the most resent one. but they can ask for the others if they want to.

Her ex husband didn't wanna give us the 1040's thats why we can't provide them,but we do only hav her  2016 1040
