hi,i have a qstion concerning the form i864 for Aos:

my wife didn't work for the years 2014 and 2015 so she didn't have any income,so in part 6 of the for the form i864,should she choose item number 20 ? and if she does what evidence can we provide ?

There is.

 

Under listing the most recent tax return income totals and year, item 20 states: I was noit required to file a Federal income tax return as my income was below the IRS required level and I have attached evidence to support this.

 

It's on page 6.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Let me look at it again then.

 

 

Ok I was using the example forms here on VJ.   They really need to be updated.  I see the Updated one on USCIS website now.

 

As far as evidence, they mean evidence of why she was not required to file income taxes for those years. What was the reason she did not have income?  Whatever it is have her write a sign affidavit explaining that reason.

If she worked but her income was below the required filing amount she should send in pay stubs, W2, or anything that can verify this.
