I filed a petition like 7 years ago for my ex husband but I was I got divorced after 6 and the half years of being faithfully married to him. For out that he was gay....so many other things things.5 months leading to our separations, I was not intimate with him. And was separated from him for 5 months before my divorce was finalized.

 

Now, I got married two months after my divorce. And now I have petition for my new husband. I attached a written copy of why i got divorce and why I got married shortly after my divorce. 

 

Previous marriage was bonifade and present marriage is bonifade. 

 

My question, will there be any problem with my new application? What is the actual time frame am i looking from start to finish? My case/petition is currently at Nebraska.

 

Any insight will highly be appreciated.

A CR-1 currently takes about 10-12+ months from filing to visa-in-hand. Your previous petition won't have any direct impact on your new petition. However, there may be some additional scrutiny during interviews (CR-1 & eventual ROC). A seven year gap probably won't raise much suspicion, but I wouldn't be too surprised if they ask your spouse about your previous marriage. Another thing that may come up is the very short time between separation and your new marriage. But if you can prove your relationship is bona fide, then it shouldn't be a big issue. Just collect and present as much proof as you can. Good luck.

In theory there should be no problem. There's no rule or law against sponsoring a second spouse. However, stories from VisaJourney suggest in general that certain "red flags" will cause greater scrutiny of your application, your story has several flags including --

  1. Sponsoring a second spouse.
  2. Getting re-married and sponsoring a second spouse within a short time-frame (<2 months).

None of these things will disqualify you outright, but you should expect to have greater scrutiny and hopefully you've included ample evidence of a bonafide marriage. 

 

Currently, the whole IR1/CR1 process is taking 10-12 months (this time has increased steadily over the past year). Good luck!

It's definitely a red flag to bring in one foreign spouse and then so soon after divorce another. Are they both from the same country?  Which one? Has the new husband tried to immigrate before?

The best thing you can do is spend a lot of time with the new husband in person, and document that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes they're both from the same country. New husband has never been to the States. I lived with my new husband for months...

I was in my ex husband home country for two years plus and it was doing this time period I met my new husband but that was after my divorce. I have every proof of my old and new marriage.... I'm just thinking whether it won't be a long ride with my petition at Nebraska.
