Timeline

Hi everyone! I am hoping someone can answer a couple questions for me. I have been married to my husband now for a year. He is Egyptian living and working in Saudi Arabia on a work visa. I want to apply for him to come to the US to live with me. Does he have the interview in Riyadh then? Also the main thing I am worried about is I have been married before. I married my ex and he was also Egyptian. We were married for 6 years. He came to the US and is actually a citizen now. I found out after he became a citizen he had been cheating on me multiple times and I feel like he was using me the whole time. I divorced him and I'm wondering how will this look on my application? Will they use that against me and deny the visa? Wondering if anyone has been in this situation before? And btw my husband now is totally different from the first and the first was my mistake?I would appreciate any input. Thank You

If he is going to be legally staying in Saudi Arabia at the time of his interview with the embassy (still assuming it takes 12 months about) then he can interview there. If not, then he would have to go back to Egypt or where ever else he would have some form of legal residency.

 

As to previous marriage, in the petition itself, I don't think it would matter especially since he is a USC now; but your new husband might definately get asked about it so he should be aware of all the details.

Thank you for your response. Yes he should be still in Saudi Arabia. But what if anything happened and in the middle of the case he had to go back to Egypt. Would they transfer the case to Egypt then? And as for him and my previous marriage he knows everything ?

Hi Farrah!

 

The interview will be in Riyadh since that's where he's currently living, unless he returns back to Egypt within the next few months. It usually takes 12-13 months for the immigration process  to complete. 

 

I do not believe you being married to an Egyptian before will have any affect if you petition your current Egyptian husband. Many people have been married before, divorced, and remarried again, as well as other's have petitioned for spouses and fiances more than once. I believe if you prove that your current marriage is strong and bona-fide, then their shouldn't be any issues.

If he moves back to Egypt and decides to keep his residency there, then yes his case would have to be transferred to the US Embassy in Cairo. He will have to contact the NVC and notify him of his change of address. Is he planning on returning to Egypt during the immigration process? If not, then I wouldn't worry about it. From my understanding Riyadh is much easier to deal with than Cairo.

There might be questions asked if this marriage happened very soon after your divorce. Or if your timeline suggests that you knew your current husband whilst still married to your previous husband. That applies to applicants from all countries. I was concerned because I married my current husband 13.5 months after the divorce from my first husband was finalized. We met whilst I was still legally married (although we had been separated for some time). At the interview I was asked the nationality of my previous husband. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Thank you for answering my questions. He doesn't want to go back to Egypt but the stability of work in Saudi Arabia isn't all that good right now. And since it is such a long process who knows what could happen. And to answer the question yes I did meet him while I was going through a divorce and we were married about 6 months later. We are both Muslim and we didn't feel it to be right having a relationship and not being married.
