Timeline

 On February 8th my fiancee was interviewed at the US consulate in Dakar Senegal and the attached document was handed to her at the end of the interview. 

It read: 

 Dear visa applicant after reviewing all documents and information presented, you have been found ineligible to receive a visa. This office has decided to return your case to the department of homeland and security (DHS with recommendation that the petition be revoked. Your original petition will be forwarded to the local service center where the petitioner originally lived.

 From this point the U.S. Embassy will not have your case. During the course of the re-evaluation by DHS, you will be given an opportunity to present more evidence and/or refute the officer's finding. However, if you are the beneficiary of a K-1 petition you may not receive any more news about your petition due to the fact that those petitions are only valid for four months.

 The petitioner can contact the USCIS customer service center at 800 375 5283 to inquire about the status of the returned petition.

 Sincerely

 Consular section."

 

Anyone had anything like this before first time looking for help as to what is/should be my next step.

Did they specify what the issue was or why they denied the K-1? Are there any 'red' flags in your case like age difference/lack of evidence....

 

At this point your case will be returned to USCIS and it will sit there for 6-8 months before it basically just expires... At that point you can refile for another I-129F petition. 

 

You can also marry and file for a CR-1 spousal visa; but without finding out the exact nature of why the K-1 was denied, the same issues could come up during the CR-1 interview and also lead to another denial.

You can request the FOIA to see. I don't know if you'll get anything specific other than they didn't believe in a bona fide relationship; but it's worth a try.

 

Everything was in order? Paperwork, affidavit of support was sufficient?

 

How many trips did you two make to see each other? There are a lot of factors that the CO had that made them make their decision, so you have to try to pin something down.

How many timeshave you met in person?

Last time when?

How long have you been together?

Was the case front loaded?

Age difference? Who is oldest?

Trouble with family?

Did you guys do any kind of religious marriage ceremony?

 

You provide to little information for us to guess.

 

Case is denied and you can wait to file a new K-1 or get married and file CR-1 but that will be pointless if you don't find the reason for the first denial so you can correct that first.

In person meet thrice I traveled there know her, her family and few of her friends, last was November 2016.

 Two years together. I am older by 11 years no religious nothing.

 I recall her telling me she was asked by CO at the embassy where do I work she responded what do I do there she said she does not know exactly what I do there but that is where I work. "She knows my work place but does not know what I do" I don't think this is really a red flag.

I am not sure on the cultural norms of Senegal or anything so can't really comment on the age difference; but it doesn't seem too bad honestly.

 

You need to ask her specifically about the questions asked. Her not being able to answer a few common/simple questions like what you do for work is a red flag to a lot of CO's and different embassies.

It is. she don't have an easy embassy. She is your fiancé been together for two years and she will be marrying you and she does not know what you do. 

 

Seen from the CO point of view can't you see it might be a problem when they have to determine if it's a real relationship?

 

Also two meeting in 2 years might not be enough for that embassy. If you file again then wait til there is more facetime and a CR-1 might be the way to go.

Hi fellow member. My husband's interview was also held in Dakar back in June, 2016. Unfortunately he received 221g notice and now the case is back at DHS under review.  I'm aware of the the reason for our denial and am ready to respond with more evidence.  Senegal is a tough embassy.  Keep the faith.
