Sad that a family gets broken up...but you need to go through the legal process. I highly doubt I could illegally immigrate to Spain (where the person is from), or any European country for that matter.

It said her husband is undocumented as well. She met him online it seems and came to the US on VWP and stayed and married him. He couldnt petition for her because he has no status.

It is the DUI that was really her downfall.

 

Under Obama administration guidelines, however, immigrants convicted of DUIs are a priority for deportation. Her appeal was denied.

 

It sucks a family had to be split apart but she had to take responsibility for her actions. If you are undocumented the last thing you should be doing is breaking the law.

Indeed, she was likely driving without a license as well.  Re reading it does look like she attempted cancellation of removal.

 

a local immigration lawyer is suggesting to anyone being put into removal proceedings to file asylum, even those who come from privileged countries.  Wonder if she tried that.

I think asylum claims are going to be tough to get approved under the current admin.

 

BTW, I browsed through the comments section under the article. Talk about unsympathetic. About 90% of the commentors are in favor of her being deported. They even want her husband deported.

Oh absolutely, but I think that the point is just to bide them time as it can take years for an asylum claim to be properly adjudicated and perhaps appealed (can they even be appealed?)

She was likely driving without insurance also.
