I entered the US on June 3, 2015.  This is printed on my green card.  I am approaching removal of conditions.  DHS just sent me a letter informing me that I need to remove conditions.  They claim that my date of entry is May 7th 2015.  I was planning to file right at the end of April or possibly as early as mid April (knowing I had arrived in June) after getting my tax returns so that we'd have the cash on hand.    I don't know if I should file earlier because DHS is incorrect and I do NOT want to risk being after my 90 days under any circumstances.  I don't know if it's even worth calling them.  I'm so confused by the fact that they think I was in the US the day after my interview happened, before my visa had even been printed.  

What should I do?  Is it worth calling them to ask?

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

So your 90-day window using June 3rd as your entry date begins on something like March 5th, right?  If you sent in your packet as of that 90-day window, you would STILL be within the 90-day window for a May 7th date.  Just get the 90-days-before-June-3rd day right, and you should be fine!

 

You said you were planning on filing mid-April or late April.  This would satisfy both days.

I'm mostly worried that late April is cutting it too close on making sure they can't claim it 'arrived late' or something.

 

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

Mid/late April still sounds like a solid buffer, 2-3 weeks before the (wrong) entry date anniversary. Send it with tracking and you should be fine?

This is a common issue - they send the reminder letter based on when your Visa was granted and not the date on the GC. If you do some research on this forum you will see that it happened to a lot of people.

 

You need to file by the date on the GC - I was in the same situation and was told to file 90 days before the GC expiration. In any cases you will be fine given tha tthe two 90 day periods overlap.

Hi there again Not a Tailor!  My entry date was also wrong on the letter I received and I was concerned. Apparently it happens often, but it states clearly on the USCIS website that the 90 day window begins 90 days prior to the date of your green card expiry, which should be two years from the date of POE.  I decided to stick to my original plan and I filed on January 18 - exactly 90 days from my green card's expiry date. This date also fell in the window of the date in the letter I received. If you file on the date exactly 90 days from the expiry of your green card, you should be fine as that is how it is worded on the website in their instructions.

 

I don't understand why or how they can figure that we POE on the day that the visa is issued, but I do believe that it's human error as it happens a lot.  Like I said, I disregarded the letter and filed on the first day of the 90 day window. The alternative would have been to make an infopass appointment in St. Paul - 4 hours away - to be told it was probably an error. I can't afford to take a day off for nothing. You are welcome to so so however, for peace of mind. I am just stating here what I have done, and that an infopass was suggested. I am not sweating this process like the original CR1, as I am gainfully employed, pay my taxes and live within the law.  I have all the evidence needed and gave it to them, so I'll just monitor my case accordingly and not overthink things.

 

Anyway...it's nice to see a familiar name here, and I wish you luck in this leg of the journey!

When you remove conditions, you have to send a copy of the front and back of your current Green Card. From that, they'll see when you actually entered, and they will actually have it in the system when you entered. They've been eroneously sending out letters based on visa interview dates due to a system glitch.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
