Now a US Citizen but want a divorce

I married a US man 4 years ago in China, came to US (California), then brought my 22 year old son.Then went through the process of becoming US Citizen. I now want a divorce (no cruelty or violence in marriage). Does my US husband have to pay me alimony (California)? Is he still responsible for me for 10 years? I have small job, pays little, but have apt's and money in China. Also have an insurance from my previous US husband's life insurance. Died before I became citizen, but money came to me. So question is, does my US husband now, still responsible for my support for 10 years? And support for my son (he is not the natural father and no adoption).

First, you son is 22 and an adult. No one is responsible to support your son, other than himself.

Second, it seems you are referring to the I864 when you mention support and 10 years. The support required by the I864 is waived when the immigrant (you) becomes a USC.

 

As for alimony or other issues, those would need to be taken up as a matter of your divorce. Your immigration and the prior I864 have nothing to do with the divorce settlement.

No support for son. He is an adult now.

 

No 10 year support based on I-864. Once you became citizen that Affidavit no longer supplies.

 

Alimony varies. You will need to consult a lawyer on the issue. Be prepared in case you will not receive any or very little spousal support because of the short duration of your marriage,
