Question about applying for K1 visa without a lawyer..

I am trying to figure out whether or not I need to have a lawyer due to my circumstances.

From my previouis marriage, My ex wife and i had a verbal argument and she went to her mothers house. I then went there 10 mins later and was let in by her brother so i could talk to her. She was still upset and didnt wanna talk, so she asked me to leave. Her mother then barged through the bedroom door where I was talking to her and rushed towards me all crazy like. Thats when I tossed water in her face and ran out of the house. The next morning I found out her mom then called the police and claimed that I "broke in" to the home and had even "hit" her daughter (my ex wife) which is all crazy and didnt happen. Come to find out my ex-wife was seeing someone else and I believe the whole thing was staged in order to get me out of the picture. to make a long story short, I was charged with Burglary 1st even though the police report said no forced entry and I was let in the house by my then brother-in-law. My lawyer worked out a plea for me to take just an assault 4 misdemeanor. (burglary 1st amended to assault 4 misdemeanor)

The problem is, after the incident my wife decided she was gonna leave me for the other guy so her mother made her file a DVO (domestic violence order) against me, so technically I have some sort of domestic violence misdemeanor in my past. My fiancee knows of the situation already and is ok with it. I was just worried if any of the government agencies would make a big deal of it or not and make it harder to get a visa. From what I read it shouldnt be a big deal, but i wasnt sure....

Another question is the affadavit of support. I only made $14,000 each of the past 3 years. It says I need to make around $16,000, so I will need a co-sponser. My father said he would do it, and he makes more than enough money. Does that usually work out okay?

I have already visited my fiancee once, and am going back next month in May for a 2nd visit. We have talked every single day since early July 2006. I am 26 and she is 19. She also is in the Philippines. We are very serious about eachother. What steps should I take to get the K1 process started? and do I need a lawyer? Sorry for the long thread, but I really want some advice. Thankyou so much!

Timeline

Go get a consultation from a qualified immigration attorney and make your decision after that. Call your local state bar for a recommendation. You should be able to speak with one without having to spend money first. If a lawyer won't even talk to you before "Taking your case" and charging you money, go find another one.

With average, uncomplicated cases, no lawyer is generally needed (and you'd probably get advice to that effect). But you have a criminal record - and one involving the kind of convictions that USCIS is very specifically concerned with.

You can search around the forums here for more on the general lawyer vs. no lawyer question - but if I were you, I'd go talk to one or several and see what advice you get. I also wouldn't worry about sharing too many more details of your situation here on VJ quite yet (because people will say something about what you just wrote, and then you'll feel compelled to correct them/defend yourself/whatever and it won't end up being so productive for you.)

The next morning I found out her mom then called the police and claimed that I "broke in" to the home and had even "hit" her daughter (my ex wife) which is all crazy and didnt happen.

The problem is, after the incident my wife decided she was gonna leave me for the other guy so her mother made her file a DVO (domestic violence order) against me, so technically I have some sort of domestic violence misdemeanor in my past.

Sorry I had to cut your post a little. I cannot stand people who create false allegations like this against anyone. Whether or not, it happened. I've seen this kind of garbage happen too many times in real life. I hope the lady chokes on a huge #######! :yes:

You might try visiting the IMBRA section here. There are several people who have been in the same boat or something close that have discussed thier probelms. I don't recall what was said but there could be some good information.

It will probably be handled much the same with or without a lawyer. You are going to have to disclose it on your application and it will likely get you in some Administatrive review while the collect info on it. In the end as long as your fiancee is aware of the incident it should be approved.

7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

i dont care if people believe or not really. I did state the truth however. The way It seems , in 99% of all cases, judges side with the women. Anyways, what would it matter if I was lying? That would only hurt myself when looking for advice. It would be ridiculous to make up a story. Then I would have a hard time getting the right advice.

I think you've answered your own question, then. If there's this much back story and confusion, you're best off with a lawyer. It will cost you, but it would be worth it.

I-129F sent and recieved by USCIS on Feb 16th, 2007-Also I fly to Vietnam to see my fiancee on today. This is the 4th times I have flied to vietnam within a year time frame. I miss her.
