Good morning,

I need information on this topic. My cousin is a US citizen and wants to file a Form I-130 to bring her mother to live in the US. My cousin lives and has lived abroad his whole life, can he still file the petition for her mother? If so, how do we start the process? what forms and documents we need to send to USCIS to start the process?

can "he" still file the petition for "her" mother?

Unless you mean the male in this case is married to the daughter of his Mother in law (in which case he can't petition on his wife's behalf for her parents), she would need to do that herself once she establishes immigration status in the US herself..

If all of the above is a red herring then....

To petition his/her mother would mean residing in the USA with proof he is a us citizen, filed taxes every year. (when of age to do so), have an income above the minimum poverty level for his/her household size for a good period of time backed up with wage slips etc.... or failing that have a co sponsor ready and willing to complete paperwork to bring MIL in if approved.

Your cousins mother ever been to US? I assume father is a citizen that has given your cousin the link to being a US citizen (not that it matters... just wondered if she ever held some sort of status in US or was all the relationship conducted on foreign soil)

Look at the guides as lots of firms to review... as a minimum I-130, I-485 & I-864....

No I-485 needed for an IR-5 as the mother is not in the USA.

Neither is the petitioner, by all accounts, and that needs to be addressed before anything else can happen.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

It was a mistake, my cousin is male and he wants to petition his mother. His father is a us citizen too but, but he and my cousin mother were never married.

My cousin is studying abroad, he is in college. The issue here is that he moved out of the US when he was 5, and have been living all this time somewhere else

The issue here is that he has to reestablish US domicile before he can petition for someone. Which is the reason why someone asked when is he returning. He won't be able to perition anything until then.
