she do not live in usa so she does not pay texas , is that problem?

That isn't really how it works. She'll need to determine if she made enough foreign income to still have to file taxes. If yes, she'll need to backfile. If no, she'll need to write a letter explaining why she didn't file, i.e. she didn't make enough.

Read the instructions that accompany the I-864 for domicile (either maintaining or intent to re-establish) and whether you will need a co-sponsor in America or can qualify on assets.

Yes. She needs to file taxes on her worldwide income; that is the law. She will need to file her old taxes.

K-3 is an obsolete visa so the only option for married people is the spousal visa, CR/IR-1.

K-3 is an obsolete visa so the only option for married people is the spousal visa, CR/IR-1.

K-3 isn't issued much anymore because there is no need. Some years ago, spouse visas were taking over 2 years to process so the K-3 was introduced so that couples could be together faster. Now that CR-1 spouse visas are being processed in a year or less (take a look at some timelines here for examples, mine included - our entire process has taken 10 months) there is no need for a K-3 visa. Remember that CR-1/IR-1 (depending on how long you have been married) means that the immigrant gets a green card immediately upon arrival into the country and can work, drive, travel, etc. K-3 visa holders have to apply for a work permit and are not green card holders for some months after their arrival. Why would that ever be an advantage? It wouldn't, hence the K-3 has become redundant.

When K3 was first introduced, IR\CR1 visas had long wait times, which led to the K3 as a means to bridge the wait gap. With that no longer the case, it's obsolete.

Did you read the instructions for the I-864? Have you found a way to satisfy the requirements?
