Cr-1 deneid after 2 month AP

Hello. Marry Christmas to all! Thank you very much everyone for the help! I wants to ask people to share them experience with the same situation like mine. Like I previously posted my I-130 petition was go back for the USCIS for the further review. On December 19 USCIS received my case.So what is next step? And how long it will take. My husband interview was in Casablanca, he answered all questions, the interview goes well . On the end of the interview the co have to him 221g form stated what case undergoing nesessary administrative procenning and they will let him know when process will be done . On October 20 I got respond for 1 of the my multiple email inquiries to embassy, that case was returned to USCIS for the review.The embassy never get back to my husband. They never issued to him 221g refusal sheet , and they never told him that case go back . Please can anyone help me with advice what should I do now? Thank you very much and happy Holidays

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Jenny and Awal , thank you for the response. I am contacted my congressman, they email to the embassy regarding my case, but got the same response like me, that case go back for review. And the congressman representative told me to wait, that is all. I want to go to visit my husband, and I don't know how long it is take for people to receive NOIR/ NOID , from time USCIS received my case.And I am worry that I will be in Morocco in that time .

What I would do is put all your evidence on a disk or thumb drive and take with you , most do not get the notices until after a year so plan ahead. You need to visit to keep your marriage strong because this is a long fight. There is a typical list of things they usually ask for I would get it ready leave the list of things with the congressman to submit for you, my congressman here in California offered to do it for me. So you need to ask if they will help to submit documents or as a last resort take everything with you and submit from where you are. But visit take photoessays and enjoy your husband

A year?? From interview time or time when USCIS receive case? I called to USCIS next day when they receive my case and they told me if they will send NOID or NOIR for 2-3 months.

2-3 month is not very realistic, it will take longer. USCIS gives out misinformation on the phone.

Yes, it has taken most people 9-12 months and even over a year to receive the NOIR letter.

It used to be 3-4 months years ago and now the agencies are backlogged and returned petitions aren't their priority so

they sit in storage.

If you put all your evidence on a disc you can submit it wherever you are.

It has to be printed out of course and they won't accept digital evidence or discs.

Make sure that someone can receive your mail and forward you the NOIR letter very quickly as you will only

have 30 days to send them the evidence from when you receive this letter or the petition will be denied.

Rarely they will send the petition again to the embassy without a NOIR but it happens in which case

you wait until the embassy contacts you for another interview.

Periodically make a status inquiry through the senator who can't speed it up but can clarify where the petition is.

It would be save to visit your husband now with someone who can alert you that a letter has arrived from USCIS

who could send it to you in the rare event the letter comes earlier.

Yes I think they tell you 2-3 months but it's not realistic if you see everyone in here isn't about 18 months. I'm speaking from my experience from Ghana

Thank you very much for the explanation. I hope is takes not so long time. I will call them every week. And I was sending to them package with letters from me and my family and friends, and so many evidence of the relationship. They never requested but I decided to do it . I hope they will attach this to my file. On the interview co rejected to accept affidavits from my family and friends so I sensdet this to USCIS. I hope it helps.

I really doubt they will look an attach.if anything they will just tell u to send once they come across your file an that can b 12 to 18 months.good luck.its all about wait wait wait now
