We sent:

4 pay stubs (he gets paid bi weekly).

A letter from work stating he earns enough etc.

his 2015 tax return (which is $3000 short).

We were RFIE saying he doesn't earn enough. But if they looked at his pay stubs and the letter from work it would have clearly shown that he does now earn enough. He just didn't at the start of last year.

I suggested to my husband that we do the following:

Print bank statements showing income: He is concerned about they don't need to see what we are spending money on. But I assume they are only interested in what he has coming into the bank account.

Pay stubs: As many as possible for the last 6 months.

His tax return again (since they asked for it, even though we sent it before).

A letter from work again stating his wages, his hours, that it's permanent, his job position etc.

A cover letter stating he was given more responsibility at work last summer and that increased his pay, which is why his yearly amount is not reflected in last years tax return.

Are there any official links on filling this out? My husband wants to go by what the letter says but I feel like they will deny the petition if that's all we do costing us more money to then send another AOS and more time.

I think what I listed above should be enough but if there are any more suggestions I'd appreciate it.

how much over the minimum requirements is he? Sometimes they will still deny it if it's only a few hundred dollars over the minimum

We're in a similar situation. My husband changed jobs in July 2015 and we ended up calculating the tax returns from 2015, finding out he didn't meet the 125% by just $1500. This year however he meets the requirements with $27,040 but we're scared for a RFIE.

We included six months worth of pay stubs, him writing a letter stating his current position, his permanent 11 hour work day, his most recent dollar raise etc etc, his boss writing an amazing letter about him and his hourly wage. You could include your husband writing a letter like we did, hoping they will read it. Go ask his boss to write a better statement about his job.

He earns $2000 over the minimum and that's with out the bonuses he gets. I think what I've said we should do should be enough then. Get all his tax return info and pay stubs and bank statement and a new letter from work. Then hopefully it should be fine if we include a cover letter explaining the situation. His tax return for this year will be well above. Just last year was $3000 short.

I agree with what you want to send should be fine.

As far as the bank statements and they knowing where the money is spent, when you ROC you will need all the bank statements

anyway to prove financial co mingling, plus lots of other stuff.

I would highlight any important information so it pops out to them. Highlight in the letter where it states his annual income CURRENTLY, highlight his paystubs where it shows the biweekly period of pay and the actual pay itself.



Also, on some bank statements (I know mine is like this), the first page will show deposits for the monthly period. Just send that one page and highlight the deposits portion.
