SO I AM THE PETITIONER FOR MY WIFE WHO CURRENTLY RESIDES IN MEXICO WHEN FILLING OUT I864 MY HOUSEHOLD SIZE IS 5 I ONLY MADE 35,402 LAST YEAR WHICH PUTS ME SHORT FOR 148.00 DOLLARS. ONE OF MY DEPENDENTS IS MY BROTHER WHO LIVES WITH ME HE RECEIVES SURVIVORS BENEFITS (5,000 OR SO YEARLY) FROM WHEN OUR MOTHER PASSED AWAY BUT THEY ARE UNDER MY NAME SINCE HE IS STILL A MINOR COULD I USE HIS 1099 INCOME FROM SSA TO MEET THE MINIMUM REQUIREMENTS FOR SUPPORT OR NO BECAUSE TECHNICALLY THATS HIS INCOME?? IM CONFUSED NVC DICTATES THAT HE NEEDS TO BE 18 TO BE A JOINT SPONSOR CAN I USE THAT INCOME TO MEET THE REQUIREMENTS OR NO EITHER WAY I HAVE SINCE THEN GOTTEN A RAISE TO 37000 BUT THAT WONT SHOW IN A TAX RETURN TILL NEXT YEAR WILL A EMPLOYER LETTER SUFFICE?

THANKS IN ADVANCE...

I'm not sure you can claim your brother's income. I assume it's directly given to him, not to you?

Cr1 i 864 question one of my dependents is a minor has income from ssa i am the payee from survivors benefits (5,436) from when mom passed away do i need to include his income in household income or not? being that he is under 18 and cannot sign a i864? House hold size is 5 based on last years tax return i made 35.402 which would put me 148.00 short to qualify i have since last month gotten a raise to salary its now gone up from 35,402 to 37,000 per year reason i ask is would be nice to be able to put those extra 5 grand from my brother as household income in order to qualify.... :huh2:
