Taxes 2006 - Single or Married ?

Hi everyone,

I already filed my taxes for 2006 and I was instructed by H&R block to file as single because:

1-) My wife doesn't have a SS#

2-) We got married 01.02.07 and so I wasn't married in 2006.

But now I am wondering, is that right ? At the moment it seemed like the right thing to do, but now I am asking myself whether we will have problems or not at the interview.

yup, thats right.

We were married 12/30/06 so had to file married....a couple of says DOES make a difference, lol.

K-1 visa issued: 12/15/2006

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

Removing conditions:

mailed 5/22/2009

Recieved at CSC 5/23/2009

Check cashed 5/27/09

NOA date 5/26/09 - still not received

I-551 stamp in passport 6/19/09

Biometrics notice date 6/16/09

You can file as being single even if you are married if you want to, even if you have been married for a while. You file as "married, filing separately."

2/23/07 - Mailed AOS packet to Chicago

The fact that your spouse didn't have a SSN is irrelevant (there are ways around that if necessary). The fact that you were unmarried on 12/31/06 is VERY relevant. Since you were single on the last day of the year, you file as single for tax year 2006. You don't have a choice of filing as married for 2006.

You can file as being single even if you are married if you want to

No you can't. If that were the case, there would be no such thing as the "marriage penalty". If you're legally married, you must file using one of the three filing statuses available to married people. Either married filing jointly, married filing separately, or head of household (HoH is only available if you meet other specific requirements). A filing status of "single" is not available to married people.

(I note the rest of the post quoted above says you can file as married filing separately, which is correct, but MFS is not the same as filing as single).

I am getting ready to file my taxes this week. And have been wondering about this subject also.

My wife and I were married December 16 2006 but she does not have a social security number yet.

Does anyone no if we can file married / jointly without her having a social security number?

I see from Reading the link that you provided that I will not have time to apply for a number as they take 4 to 6 weeks to recieve so I will just file married separately this year.

I should have thought about this sooner but have been busy

If you file married/joint, it is my understanding that you need to provide an income statement for the foreign spouse. My wife can't get an income statement yet for her 2006 income, so I'm filing "married/separate" for 2006. I hope we will get an income statement for her '06 earnings later this year, since we can amend my '06 return and save a few thousand $$.

But we will see.

After all, its Russia.

For some reason I thought the marital status question referred to my CURRENT status and not my status as of 12/31.

Cool... but she probably wont need an ITIN since hopefully she will have her SS# before april, 2008.
