120 days since filing; processing not yet started - experience?

Hi everyone

I posted about 6 weeks ago about how we filed a K1-petition at the end of May and hadn't received anything from USCIS, and I was grateful for the answers I received to my post. Yet, our situation has not changed yet; we are still waiting for our case to be processed. My fiancée is the USC, so she called USCIS a number of times, but every single time, she gets the same answer, which is something along the lines of them having received our file, but also a huge backlog and that our file has therefore not yet been sent to a service center. According to USCIS, they can not assign us a case number yet.

Through this forum, I have seen many others getting their NOA1s within a couple of days, and their NOA2s within the same time frame we have been waiting for our petition to even be looked up. I am very happy for each and every case that gets approved, but also a little sad for ourselves. We are thinking of hiring an attorney and hope to get a couple of hints as to what to do in order for them to start looking at our file.

Have any of you of made the same experiences? How did you go about that? Any experience would be highly appreciated.

ROC: 

12/30/2019 package sent to Texas Lockbox via USPS

09/27/2021 hard copy interview notice received (issue date: 09/21/2021)

10/27/2021 interview (10.40am), approved

11/06/2021 oath ceremony (7.30am)

USCIS has 5 months to process your application. If at the end of the 5 months you have not heard anything then you can do four things:

1. Call them on the phone. (I know you called many times already but then you were within their window but now you are outside your window and they have different procedures to follow)

2. Schedule an info pass meeting with USCIS at your local USCIS office. Schedule an INFOPASS appointment through the following link: https://my.uscis.gov/appointment or

https://infopass.uscis.gov/

3. Make a formal inquiry from here https://egov.uscis.gov/e-Request/Intro.do

I wish you luck. I know how frustrating this is. We are waiting on my wife's ROC and it looks like it will be a year to adjudicated those who are processing there VSC. Others who processed through CSC started getting approvals after just 6 months. Kinda sucks but what can you do.

Timeline

USCIS is telling your fiance that they haven't assigned a case number or sent it to the service center? And you never got noa1 in the mail?

Unfortunately, there isn't much help available until after the 5 month mark. At that point, I'd be calling USCIS again and inquiring with my congressman to check on the status for me.

Thank you guys very much! It is calming that there are options after passing the 5 months mark. That means we will just keep waiting for the moment.

V&SP, I wish you best of luck and hope for both of us that someone will finally start working on our applications.

Congratulations!! I'm so happy for you two!

Your news gives me a little hope that we may still get our NOA1 as well. We will call USCIS again as well when I visit in two weeks, and hopefully, they will do something about our petition as well. Did you speak to tier 2 supervisors?
