My sister was denied entry to the US in 1997 because she did not have a proper work visa. She was barred for 5 years and did not attempt to return to the US until 2006. She was denied entry in 2006 because she did not have a waiver. She was told she cannot enter for 20 years. can she try to get a waiver now?

Sounds like a 212 d 3 is needed.

However sounds like the bar would be up next year anyway.

It is a type of waiver, for non immigrant categories.

No bar no need for a waiver.

I forgot to mention, if she had a name change during the time she was banned and have not entered the US but would like to enter the US would that cause any problems?

Canadians are weird, she would need I think to go to the PoE and apply there.

Thank you! would she be able to apply for work in US in the future? At present she works for a multi-national company and they are looking at promoting her and she would need to work in the US.

Best to talk to her Employer and their Lawyers. Devil is in the details.

I'm confused how is the bar up next year when they got the 20 year ban in 2006? They got a 5 year ban in 1997 and 20 years in 2006. Correct?
