Understanding processing times, NBC or field office?

Timeline

Currently my husband's AOS is at the NBC. I understand that all 485s go there and are usually farmed out to local offices for interview as needed. I'm not getting which processing time I need to be watching, our local office one even though the file isn't there yet, or the NBC which does not show any listed time for I485s.

Finally, is it normal that the USCIS processing time website seems to be on some sick standstill for certain local offices? Ours apparently hasn't been updated since June 30 and it is now September. If the image doesn't attach, forgive me! Below that box, it said last update Aug 11, 2016. So is this current for June 30, or Aug 11? So confused :( :( :(

When did you file the AOS? If your NOA date was the June date, then that may be the last time they "hard" touched it, meaning they actually did something with it. The August update may be a "soft" touch, meaning they looked at it but didn't do too much that would matter to you.


Did you apply for EAD and/or AP? Have you heard anything from those?


I know that people who filed with me in April that had interviews, are just now having their interviews or are still waiting for their interviews to be scheduled. So that's a good four months for the one's who have august interviews from the time of NOA1 to Interview. There are also people from April still waiting for an interview.

Has your husband done his Biometrics?

There are also cases of peoples files being sent to other field offices or staying at NBC.

I'm assuming that since your husband has had removal proceedings started, then terminated, and then AOS started and you dealing with ICE before that it may take longer to process as your husband has more of a record for them to go through.

I need to fill in my timeline, sorry! NOA1 was March 23, initial RFE April 21, RFE received may 11, EAD arrived May 25. Nothing since May 11 on the case tracker.

That June and August date are something about the Charlotte office, nothing to do with our case at all

Oh okay. If your case tracker hasn't been updated since May, I would go ahead and call in to USCIS and ask to speak to a tier 2 to find out where your case is/it's current status.

Our local office is processing i485s as of February 18 this year. Tier 1 seems to think there is no need for that til our date of March 21 goes past on the local office processing time. We even did an inquiry and it wasn't assigned to anyone for that reason. Our lawyer is saying things are just backed up and that its a sit and wait thing

We sent ours in April and we didn't see any updates on computer so in June I called and a week later was updated by July we got a rfe we replied and by end of July we go the ead combo and on sept 1 we got approved for I 485 . I would say call if it hasn't been updated by 60 days they will send a request in the computer to update

Timeline

All the adjustment of status applications are first sent to the USCIS in Missouri to be reviewed. This office determines if the case will be waived for an interview. Often, to help process the cases faster, they send cases to other USCIS offices to help review the case. And it's not always an applicant's field (local) USCIS office. If it happened to your case, it can be difficult to figure out the location of the case.

AOS can take from few months up to year and even longer. There have been a lot of people here, on VJ, waiting for their AOS about 15-16 months.

I DO hope you are getting closer. Really :)

Have you been told your case, actually, is at the local office?..

For my AOS, the customer service was absolutely useless. After few phone calls i recognized I was told different things, and even the whereabouts of my case wasn't consistent between the diffident USCIS representatives.

The website was not accurate with updates either. I had as "many" as two updates: First - they accepted my bio-metrics. And the next one showed up 15 months later, with my AOS approval. And unfortunately, i wasn't the only one in this "boat"..

Don't get me wrong - I don't want to upset you.. As I said I really hope you will have your approval very soon. I wish it for everyone because a long wait is a pain :( Just in case, you should be ready to wait longer. It happens. AOS is unpredictable and you never know how long it can take.

Have you applied for Employment Authorization/Advance Parole?....

My husband has had his EAD since May. AOS sucks, it's seriously a form of torture.

My husband has had his EAD since May. AOS sucks, it's seriously a form of torture.

I'm glad he has his EAD.
Just again, an advice from someone who has been "there"... If there is nothing from USCIS till January 2017, you should file for his EAD renewal (120-90 days before its expiration date, but 120 would be better). I was waiting to the last moment - simply couldn't believe my AOS still was pending :( and then I had to expedite a renewal of my EAD, taking a risk and having a huge chance to lose my job if they would've denied my request.
Also, when you file for your EAD renewal, very often it makes the USCIS to start working on your case if it has been just "sitting" on somebody's desk...
One more time - GOOD LUCK and hope for a good news about your hubby's AOS soon!!!

I figured after the new year we will look at renewing the EAD. I asked a few on here who had one year plus aos processes and they all said it was granted to renew the EAD again no problem, and we would just let our lawyer handle that one. Still hoping it doesn't come to that, but a small plus would be he skips conditional and goes to the 10yr card....trying to stay positive lol!

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

(AOS AFTER TERMINATION)

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

HAPPY 2YR ANNIVERSARY TO US!!

Infopass #1 at local office: Dec. 19, 2016- Case pending background/security checks, advised when to renew EAD #2

Waiting on interview at local office...... :clock:

Sent EAD renewal: Feb 10, 2016

EAD#2 NOA1: March 3, 2016

INTERVIEW SCHEDULED!!: interview on March 27, 2017

Still hope it won't come to his EAD renewal, but if it does, it's really easy to apply without a lawyer. It's just a little paperwork and it doesn't take a lot of time.. The form I-765, I-1145, 2 pictures, copy of his previous EAD (front and back)..That's it :)
