The law is clearly defined. If by November 21st and your marriage is not exactly 2 years old, you will get a conditional 2 year GC. It doesn’t even matter if your marriage is 1 years, 11 months, 3 weeks and 6 days old by the time of interview. There is NO provision in the law I’m aware of that permits officers to issue 10yr GC to applicants who are few days or months short of fulfilling the marriage duration requirements. To be on the safe side, my best advise to you would be to reschedule your interview for a later day when you must have fully met the time requirement. Yes you may have waited so long for this day, yes it’s gonna prolong the process even more but at the end of the day it’s a wise decision and a cost savings option cos you’ll bypass the ROC process and move straight to naturalization when u become qualified.

I did a google search and it stated that they suggest rescheduling if you are sick.

Exactly! That’s what you should do. Reschedule it on the basis that you aren’t too feeling too well and won’t be able to make it that day. Good thing is they don’t normally require documentation proving the reason you aren’t able to attend your original interview. By the time you go for ur next interview, you’ll go in fully confident you’ve met all the conditions necessary to AOS for a 10yr GC.

No, I am still waiting. Hope to get is soon... My driver license expires in the beginning of December.

I guess, if I don't get my GC by the mid-November I will have to set an infopass appointment to get a stamp, so I can renew my driver license in time. I don't think DMV would accept just the approval letter.

I'm going in for my stamp today. I'm a month less 6 days from my extension letter expiring. I'll let you all know how it goes. 

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Hi, my oath letter for N400 has just been posted online. I just want to update the tracker since the I 751 was approved concurrently with the N 400 during the interview. No letter received however the officer has said I won't receive my 10 years GC.

I got my stamp. I arrived about 20 minutes early but they let me in anyway. Got upstairs and left my infopass in a plastic holder and took a seat. Got called up in 5 minutes, told her I was there for an I-551 stamp since my letter was close to expiring. She took my index prints, a photo, disappeared out to the back to do the stamp (she handwrote the dates and the other pertinent info) then gave my passport and extension letter back. She kept my green card, so I no longer have that. That's about it!

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I751 journey - CSC

09/12/16 : package received

10/11/16: Biometrics

07/28/17: I551 stamp on passport expired 07/27/18

10/25/17: Combined interview N 400 and I 751. I751 approved on the spot. Read the I 751 interview Here.

 

N400 journey : Dallas Field Office

07/26/17 : applied online, got NOA online, CC charged

07/28/17 : biometrics scheduled online

08/01/17: NOA received on the mail

08/02/17 : biometrics online PDF posted

08/05/17 : biometrics letter received on the mail

08/15/17 : biometrics done

08/19/17 : Online MYUSCIS and ELLIS posted interview scheduled and will mail interview letter

09/20/17: received text messages and emails that interview has been scheduled

09/22/17: Interview PDF posted online on MYUSCIS
