AOS ...RFIE ...need help pls

Hi every one ,I got rife yesterday ..I am little confused as they said that our income can't meet the poverty guideline .

We sent every thing at the first place ..

Tax return 2014,2015

W2 past 5 years

Bank letter ( tho we don't have much money in it)

Work letter ..saying full time job make over 40 k per annum

Lease of apt.

Insurance ...everything we send them

& now the letter says we can't meet the criteria ..

I am so frustrated what they need ??

Plz help vj experience people

What exactly did the RFE say? Lease and insurance has nothing to do with the I-864.

it has following box ticked.

Based on thr documents submitted with Form i864 ,affidavit of support , for the petitioner/sponsor, the income did not meet 125% (100% if miitary ) of poverty fuideline for the petitioner/sponsor household size.

submit evidence of assetsthat meet the standards listed below or obtain a joint sponsor.

Assets must equal the stated difference between the petitioner/sponsor household income and 125%((100% if miitary ) of poverty fuideline for the petitioner/sponsor household size.

. Assets must equal the difference for applcants filing as orphans.

.Assets must equal three times the difference for spouse or child of a USC

.Assets must equal five times the difference for all others.

Evidence of asstes includes.

.Bank statment covering the last 12 momths(statments will be averaged over a 12 months period) or a statment fro an officer of the bank or other financial instiyution in which the sponsor has deposits, the account balance over a 12 months period,and current balance.

.Evidence of ownership and valuse of staockes,bonds, and certificates of deopsit.

.Evidence of ownership and value/equt of other personel property and dates acquired.

.Evidence of ownership, a recent licenced appraisal of county tax assesment, and any mortagege /lien or lien relaese of any real estate.

If you decide to obtain a jont sponsor they will need to.

.File form i864 ,affidavit of support

.Provide copies of their most recent federal income tax returns

.Provde copies of all supportinh tax documents(W2S,1099s,form 25555,and tax schedules)

I have sent w2 2010-15

Pay stubs 6 months

Apt lease

Work letter from employer 40 k per year

Tax 2014,15

Insurance

Don't know how come we don't meet poverty income limit!

So stressed

Even in our poorest year which was 2013, my wife is $15,000 over the limit.

Maybe you did not fill out the form correctly or maybe not all schedules were attached to the tax return, that is why official

IRS transcripts are better than tax return copies.

It sounds like a general RFE and they always mention assets, I believe you missed something on the form or something else is wrong

somewhere.

Note that, as you were previously told, insurance and lease have nothing to do with this.

There are no kids ? Just you and your wife ?

If we send 2013,2014,2015 IRS ,will we be fine?

I'm worried if after we send that ,still USCIS not satisfy or deny us

??? What they can possibly do

I don't know what went wrong if you make over the guidelines.

They can either deny you or send you a second RFE if you don't send them what they want or get a joint sponsor.

I would have a lawyer look over exactly what you send in and hopefully you have a copy of the form

he can take a look at.

Other than that get a joint sponsor or send official transcripts and a letter of explanation of why you do meet the guidelines

and re send all evidence.

I hope there was no mix up with the name issue you previously had.

No, you figure out what the problem is with a lawyer to guide you if you can't figure it out yourself or you find a joint sponsor

and then you simply file again. You do not have to leave.

Include a statement pointing out the fact that you earn more than enough to meet the 125% income requirement, and are providing a letter from employer and pay stubs to prove it. Sign and date the statement.

Sometimes for whatever reason, they can overlook evidence that was already submitted. Sounds like you provided a lot of extras that did not need to be included, so perhaps the actual documentation that was needed got lost among all the papers in your submission.

Agree - We had a similar but slightly different RFIE where we absolutely did meet the guidelines and something we originally submitted must have been overlooked.

We basically resubmitted what we'd sent but with more bank statements/payslips going from one year prior to filing to current date (200+ pages total - you want evidence, you got evidence!) and explained how we most definitely did meet the guidelines. It seems to have worked as we got my EAD a few days later and a few days later than that we got notification that I was scheduled for interview.

the bottom line of tax papers is what is the income line 37 (2015 taxes) your adjusted gross income

look at this line as that is the line immigration officers are trained to look at

they don't care and look at any other line (according to the immigraiton lawyer i consulted )

this line must satisfy the 125% rule

for California as it says you live there

it is (over $19900)

Yeah I'm gonna send that again , but we don't have enough money in our bank , regardless my wife earn over 40k but expenses are more like student loan, insurance etc etc

Do u still think I have to submit 12 months bank statement ??

Also you are right ,I submitted lots of docs, may be case worker didn't looked into it properly .. Unfortunately

We definely you meet the poverty limit

Can I submit the same work letter or new one with this month date on?

I just wondered case worker should ask in specific that he wants ..w2 ,pay stubs ,irs etc

Regardless he didn't look anything we send because it clearly shows he didn't look into file of docs we submitted, every thing is in there
