So Part 6 #2 and #15 should list the $40k. Provide the 2015 IRS tax transcript. Provide again the letter from employer and most recent 6 months of pay stubs. Include a statement pointing out the fact that you earn more than enough to meet the 125% income requirement, and are providing a letter from employer and pay stubs to prove it. Sign and date the statement.

Sometimes for whatever reason, they can overlook evidence that was already submitted. Sounds like you provided a lot of extras that did not need to be included, so perhaps the actual documentation that was needed got lost among all the papers in your submission.

I believe KayDeeCee has the right approach. There is no need to heavy load on evidence especially if they will not be needed. If your income satisfies the requirement, follow what KayDeeCee says and stop sending bank statements.

I did send bank statements showing highlighted deposits when we received a RFE.

I also submitted a bank letter showing total deposit amount for each bank account.

What if we have not enough money in saving let's say we have $100

But we can show irs pay stubs that we making 40k

It does not matter how much you have left in the accounts, what counts are the deposits. They are not worried about

how you spend your money.

One more detail, the 2015 tax return... are there are dependents claimed on the tax return? If so, these are also counted as being part of your "household".

For example, if your wife filed single or head of household and you're saying it's just you and her.... but she also claimed 2 nephews say... your household size is 4 not 2.

Do I need to refill the i864 form again?

And or do I have to send the supporting docs,like insurance ,lease etc?too

As we mentioned before, a lease and insurance is not supporting evidence for the affidavit of support and has

nothing to do with the income. You only send it IF THE RFE listed you need to submit relationship evidence.

You got an RFE stating you don't meet the poverty guidelines so focus on the income.

Submit what KayDeeCee suggested:

"2015 IRS tax transcript. Provide again the letter from employer and most recent 6 months of pay stubs. Include a statement pointing out the fact that you earn more than enough to meet the 125% income requirement, and are providing a letter from employer and pay stubs to prove it. Sign and date the statement."

Add to that a bank letter showing deposits from the last 12 months and bank statements highlighting all deposits.
A new form does not need to be filled out (unless you made a mistake filling it out.)

But even tho my wife has 2200 comes in the account each month..but she has to pay credit card loan ,students loan etc & we end up living pay check to pay check .

Do u think it will give them bad image of having no saving ?

I'm very stressed and worried they might not deny us

It's not about a bad image it's about meeting the income guidelines. Stop worrying where there is nothing to worry about.

the bottom line of tax papers is what is the income line 37 (2015 taxes) your adjusted gross income

look at this line as that is the line immigration officers are trained to look at

they don't care and look at any other line (according to the immigraiton lawyer i consulted )

this line must satisfy the 125% rule

for California as it says you live there

it is (over $19900)

This is incorrect in a couple of ways. First, you list your current annual income where asked on the form. That is the amount that must meet the requirement, not the income you made last year. You provide letter from employer and/or recent pay stubs to prove that amount. Secondly, if you are self-employed and actually do use the tax return as proof of income, they will use line 22 of the most recent 1040. That is the Total Income line, and not the AGI. The same amount you will list for the last 3 years of taxes where it asks. It never asks for the AGI anywhere, unless you used the 1040EZ form, and that is for the 3 years of tax info, not for your current income.

People tell you things, and then re-ask the same things over and over, as if you do not even read the answers you receive.

It is not about debts, and you are not using assets because the income meets the requirement, so it does not matter how much you have in your savings.

What do a lease and insurance have to do with meeting income requirements? Where are those asked for in the I-864 instructions? Nothing and nowhere, as you were already told a couple times in this thread.

If you made any mistakes on the I-864 you provided before, then fill out and send a new one, otherwise, no need. You need to focus on pointing out to them that your wife meets the requirement, and provide the proper documents that will prove she does.
