Hello,

I apologize if this has been addressed in its own way. I just can't seem to find specific information and numbers.

I am a United States citizen and my fiancee is Indonesian. I was wanting to know the steps I have to take to get the K-1 visa, but the biggest problem I'm facing is the income requirement.

I currently live with my grandparents and they're very fond of my fiancee. We were going to live in the house with them, just so we could be together while I continue to work and save up for our own place. She works too and has a few degrees, but I don't know anything about the process.

The combined income of my grandparents and I is above the poverty level that is required, but I'm not sure if it's too little still.

Can anyone shed some light on this for me? Sorry if it seems to be a stupid question. I'm just really new to this stuff.

Check here https://www.uscis.gov/i-864p for the guidelines. Your grandparents would need to be at 125% for their household size (include your fiancé in that number). Hopefulky that will let you know if you're on the right path.

05.12.16 - Petition received at USCIS

05.16.16 - NOA 1

05.21.16 - Hard copy NOA 1

07.21.16 - NOA 2

07.25.16 - Hard copy of NOA 2

08.05.16 - NVC case number assigned

08.10.16 - Case received at consulate, packet 3 received, DS-160 submitted

08.11.16 - Packet 3 mailed to embassy

08.18.16 - Packet 4 received, visa fee paid, letter from NVC arrived

09.02.16 - Medical

09.22.16 - Interview, received 221(g) :crying:, Case changed to administrative processing for missing documents :protest:

10.03.16 - Mailed off response to 221(g), bye bye passport

10.04.16 - Package containing documents + passport arrived at the Amsterdam consulate

10.17.16 - Approved!!!

There is no combining of incomes on I-134.

You will always be the main sponsor for I-134, but if you do not meet the poverty level requirement, your grandparents can be co-sponsors which they have to meet the poverty level for their household + the immigrant.

What about my finacee's income? Would it be easier for her to come here on a work visa?

1) if your fiancee's income is NOT going to continue (quit her job) after entering US, then no.

2) She could try for a work visa, provided she finds an employer who is willing to file the paperwork for her.

Perhaps you could look into working another job to meet the poverty level requirement? It is $20,025 for 2 person household.

I live in a pretty desolate area in Arkansas. There's just not much going around here. I'd definitely have to have a co-sponser to get her here. But I'd have to meet that poverty requirement for at least three years before they would consider it though, right?

It is not necessary that you have to meet the poverty level requirement for at least three years.

Some US consulates may want see 3 years of tax transcripts over the poverty level requirements, some may only be concerned about your current income.

I don't work and haven't and my dad is the sponsor is above the poverty guidelines and we didn't have a problem getting approved and we need to show his 2015 tax transcript at the interview. Every embassy is different but I'm sure if you will be living with them and combined it's over the guidelines they're asking you should be fine.

You are wrong here

There is NO combining of incomes on I-134.

OP will be the main sponsor here.

The Co-sponsor / joint sponsor must reach the poverty level requirement alone.

In your case, you are the main sponsor with 0 income while your dad is the Co-sponsor / joint sponsor meeting the income requirement.

Oh no I never said that I wasn't the main sponsor- I was just saying that since OP said his income and his grandparents who will be his potential cosponsors are over the poverty guidelines than he should be fine. I probably didn't read right that only COMBINED they make over the poverty guideline- not just his grandparents.

My apologies for any misunderstanding I was just stating I have zero income and my dad is my co sponsor and I didn't have an issue as of yet because he meets the guidelines alone. It's 3 am where I am and I must've misread it.

nope, your fiancé needs to be included

for the i134 you can only have one joint or co sponsor

and they don't even qualify for the affidavit of support once you're married, for a household of 3, your grandparents plus your wife, they would have a combined income of more than 25 thousand

The current job I'm working, I make 26,880 dollars a year. However, I've only been working there a month.
