Who exactly is making decisions regarding green cards?

Hi! Im confused here. I tried to research on google but i need more clarification, if you don't mind.
Who specifically decides if the application is approved or not? Mostly interested in AOS applications (concurrent i-130/i-485).

For example, from Immigration officers on the phone (we spoke to tier 2 few times, in fact) and from Infopass i understood that the officer who we had interview with will be making a decision. For example, we were told that the officer (they even told us her last name) needs to review our case and make the decision.

But, we also went to senator's office for help (more in my signature), and they said that they will contact National Benefit Center.

So, who is making the final decision? The officer who we had interview with or National Benefit Center? Why are they contacting National Benefits Center then?

It's the officer wo interviewed you (or their supervisor, if the officer is still a junior officer). However, if you are stuck in background checks, there is nothing that officer can do until the background checks clear.

Thanks! Do you know why senator's office compacting NBC then? Also, i heard that the background check should not prevent them from making decision if it takes longer than 6 months. And they never said it was background check, we asked like a million times

Oh, i see... do they do it even after interview in some cases? If the officer request something after interview, if i understand correctly, right? Because some cases are approved at the interview.

And then, if everything is ok, it means the officer is just taking their time?

Something is going on with your case. They don't just take their time like that. Either your file is misplaced or you are in background checks. At least these are the only two things I can think of.

Well, from my husband's words, when he went to Infopass, they do have our case. There was a note left by the officer that they need more information, but we never received any RFE. The supervisor said they will ask the officer if anything else is needed and we should wait for 30 days. 30 days has passed and nothing, went back to info pass, the guy said that there is no time frame for the officer to review the cases and sometimes it takes up to 4-5 years (!). The marriage cannot be any more real, they can check whatever they want. None of us had any criminal records, never been arrested, nothing like that.

It does NOT take 4-5 years, that's ridiculous. Still sounds to me like this officer placed the file somewhere other than his desk and forgot about it.

I still wonder if the extra information needed is to do with background checks, that would be consistent with them not needing anything from you.

It has nothing to do with having a criminal record. It can be something like somebody with a similar name who does have one.

As for it taking so long I'm not sure if it will matter who you contact but for my case I contacted my local Congresswomans office. And I just kept being persistent at infopass appointments. When you go for your infopass appointment are you asking to speak with a supervisor? Because the first IO I saw I was just assigned to by a ticket number and that person jjust told me to fill out a service request and basically couldn't do anything to help me. But then The second time and thereafter I asked for a supervisor and that's when my case moved.

For me I needed Congreeswomas office, supervisor at infopass

Thank you! My husband has a pretty common name, who knows... In fact i really want to know what it is, but i messaged some people who had similar problems in the past and they never knew what was the problem with their cases. Which just makes it even worse if there is no problem and uscis simply being lazy and ignoring all of our inquiries. Because i would even understand if they are working on something, I'm mad that they don't give us any information besides "wait".

Thanks! My husband talked to supervisor on May 25th and thats when he was told to wait for 30 days. Did you ever find out why it took longer that promised? I couldn't figure it out from your signature, sorry.

Hi banana, I wonder if maybe the back ground check is being help up by a stubborn government? Where is your husband from? I have some experience working with these type of things in my line of work. I think If I were you I would start looking up that route.There are governments who really hate sharing info with the U.S and will drag things out, especially if he has a common name.

Thank you for you opinion! My husband is american, he was born in US, i am from Russia but he has nothing to do with Russia. His name is a common american name, but not mine. My name and last name are very uncommon for any country, including Russia, never met a person with a name like mine (i even tried to search online, there is no one but me, lol) Also, there is not much to share about me really, i moved to US when i was a student (J-1 visa) so i didn't have any suspicious job in Russia or anything like that.

Could be... you have a good point about money, lol. I should research that because i don't even know who to call, thank you. The weird thing is that i-130 (my husband's petition) is still not approved either, no updates about i-130 since March 2015.
