Trying to decide which visa is best

My fiance lives in Canada and I live in the US. We keep hearing that it is better to get married here in the US and then file paperwork (a K3 perhaps?) from the US. We are not sure which visa is best. We want him to be able to stay in the US while the paperwork is processing. Any advice would be most appreciated.

He can't enter the US for visiting purposes with an intent to immigrate because it would be considered immigration fraud. You can either file paperwork for a K-1 visa or marry and file a CR-1. The K-3 is obsolete now so it's not much of an option. He can come visit you and file the paperwork while in the US, but he must go home within the designated time.

During the time the petition is pending, he will be able to come and visit you but, he will need to interview and complete the consular processing in Canada. Here's a guide comparing the visas: http://www.visajourney.com/content/compare

A K-1 visa will allow him to marry in the U.S. and stay while the paperwork is processing. It is a fiance visa.

A spousal visa or a fiance visa will take about a year to process in total. There are guides at the top of the page that can help you decide. We went the spousal visa route as working and traveling right away is important to us.

Keep in mind that all visa interviews are through Montreal now

Good luck

It's illegal to visit the USA with the intent of immigrating. You can do the K1 visa or the CR1 visa.

http://www.visajourney.com/content/compare (ignore the K3, it's obsolete and very rarely granted. Like less than 1% of the time.)
