I am a USC, and so is my mother, my dad is not.

My parents were married abroad in the 60's. For some unknown reason, my dad never applied for citizenship or any other papers (though most likely due to potential issues with local government at the time). He does have a long term (10 years) visa to the US and visits often.

What choices would they have today, should my dad want to apply for any type of permanent residency in the US?

Thanks!

Either you or your mom would need to file a petition for him.

they are still married but do not live in the US.

I am reading the guide now, but could not find the following:

1. Will my dad be required to stay in the US until he gets a parole document (i recall this from my the K1 process), if he is here while starting the application, and how long would that possibly take?

2. What is a common time frame for this procedure (either I130 or I485)?

1. He will be granted a green card that will arrive at the address he chooses after he comes here. So there will be no need to adjust status and he's free to travel overseas. But remember that a green card grants him a permanent status, so he needs to have the intention to reside here not just have short vacations.

2. It's a i130, he won't need the i485. He'd need that if he was here already. It takes around a year.

While the I130 application is being processed - will he be able to travel to and from the US, if he has a valid tourist visa (which he already does)?

And finally - my dad is older (75+), does that affect the process in any way?

He can visit, yes, but he may be questioned further during his entry because he has a pending immigrant petition. As long as he shows ties to his home country, he should be fine visiting.

Age doesn't matter.

hi

nothing has changed, he abandoned his GC and a new petition needs to be filed, the only thing is, since he does have an alien number, the number that is on his original GC, you will need to put that number on any form that requests an A#, since that number is his for life

and if he has a social security number, that goes on the form as well, those numbers are for life and he won't be given another one

I think the social security number would be easy to find in his records, however, is there a way to find out the A# if there are no surviving documents?
