K 1 Visa Questions (merged threads)

Timeline

HI there,

I am planning on driving across from Canada, POE, to meet my boyfriend - fiancee. (L) We have not filed yet, but plan to file for K 1 after July 20 (divorce final)

Needing some advice:

- crossing the border to meet him. He is flying up from Florida. We plan on renting a car from a city close to the border. I want to cross with my dog, then we will travel/drive together to Florida. I will have one bag and golf clubs in the car, no other possessions. except my dog!

-spend a month together. Fly back and pick up my car, drive back to Canada. Dog will stay in Florida.

-when I cross, I will have documentation proving my mortgage (house is currently for sale but not sold), job in the fall teaching, bank statements, return flight one way from Florida to US border city where my car will stay.

Questions 1. Will I have trouble at the border?

2. Can we file while I am there (from Florida) after July 20?

3. Lawyer:

My fiancé and I have been back and forth about this--we are both very educated and the forms seem straight forward. Do you have any advice about potential pitfalls regarding the paperwork process. We would love to save the 3 thousand dollars the lawyer would charge if we could.

Timeline

1. Probably not, Canadians rarely do

2. Yes, that is fine, as long as you leave on time

3. This is a DIY site, so most couples here file without a lawyer. They can be useful if you have difficulty filling out detailed forms, or have big red flags (waivers needed, criminal past etc), but that doesn't seem to be the case for you.

Keep in mind a K1 takes 6+ months from filing to interview; you may want your dog with you during that time, but that is up to you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
