I was just curious if anyone has gone through the consulate interview and NOT been asked about a criminal record( and has had one ) ? Or those that did have a record and responded yes to the questions, did you get approved without needing an I 601 (I 601 A) ??

No criminal record personally, just choosing to chime in. They absolutely ask in interview, and if you lie, or get caught that you never disclosed it, you can get a lifetime ban for misrepresentation. Expect questions, answer honestly. It's better to disclose everything - especially since your background checks will show it anyways. Good luck, I hope you don't need a waiver.

It depends on the crime whether or not you need a waiver. I have a conviction for theft and an arrest for a fight, all they did at the interview was thank me for being honest with them and for providing details of it to NVC. They didn't ask for any details about it at the interview.

It will be under scrutiny of course, you are applying for a green card not a library card. The best thing you can do is be honest.

just be honest on the answer because they will know it and if they will. good luck to your visa.

I wasn't asked about a criminal record at my interview but if I remember correctly, the question appears on the DS-260?!?! Plus they have your police certs and they've done a background check on you, so they know if anything's there. Sometimes they will ask you an innocent question that they know the answer to, just to see if you'll tell the truth. E.g. in my interview, they asked me where my USC husband works, even though they knew he was in prison, just to see what my answer would be. Always tell the truth, misrep will get you a ban in two seconds....

Whether or not you need a waiver depends on the crime.
