Yes, I know that's why I said "can" and asked if they're even in their original 90 days. Clearly OP should have looked into this before leaving but he didn't and so now he's here asking this question and not "help there's an emergency and I have to go home what do I need to do so I don't screw up my K1 process".

Hi all.

First of all Id like to say a big thank you to you all for taking your time to help me. You have all helped! Due to the sheer number of responses I got to this in the first day I have had to read them all and mull everything over today.

Some facts which some people have asked for:

We did not get married within the 90 days period due to having to leave urgently to attend to a family event.

The 90 days have since passed.

Those are the only 2 facts which are important right now. My fiance is visiting me next week so we will discuss which visa to go for next, either the K1 again or the CR1.

Again thank you all for helping me on this delicate matter.

As general information:

If someone else needs to leave on an emergency basis before marriage but within the 90 days, he or she should contact the consulate that issued the visa to let them know the situation (ahead of time), and to find out what options there might be.

Yes if you have an emergency where you have to leave NOW and you haven't gotten married yet do what TBoneX said.

If you can wait a few days, get married ASAP and as soon as you get your case number go to your local field office and apply for an emergency travel authorization and you won't risk having to start your process over if the consulate says no or you end up staying passed your 90 days. Don't call USCIS and request emergency travel authorization, that takes forever. Go to your local office and have it within an hour. Bring case number, 2 passport photos and evidence of the emergency.
