My question is regarding the criminal record and is effect on K1 visa application.

My partner and I are about to start my K1 visa application, but our concern is regarding my previous criminal record which I had 4years ago in the UK. I was arrested in possession of control document and sentenced for 6 months in July 2012. (Explanation: Before I got my leave to remain in United Kingdom, I was working with fake document and I was arrested at work on July 2012).

I have been in UK for the past 12years and now have leave to remain in UK; I was in my early 30s when the incident happened.

How badly will this affect my application and I’ll like to know if I’ve any prospect at all regarding this application please. My partner is US citizen.

It'll really be appreciated if anyone can please shed more light on this please.

Your chances arent good IF you Have criminal convictions especially narcotics.

If your crime is considered a crime of moral turpitude, your K-1 will be denied. I do not know if possession of a control document is considered a crime of moral turpitude, but think it likely would come under that heading. This is something you may need to consult a lawyer on to be sure, or research deeper if your conviction falls under that heading.

I think Anitafeliz still thinks it's to do with drugs. You"re talking about using fake documents to gain a UK benefit, correct? I believe that falls under CIMT as fraud.

Not a deal breaker and I doubt a CIMT, but if it is deemed to be then just needs a waiver.

You will know more once you have your interview. It is very possible you may be denied but eligible for a waiver. It will add time to your process but not the end of the world.

Obtain all court records to present at interview.
