Hi all. Ive had my green card for 5 years now and getting ready to apply for my citizenship. Id like to bring my girlfriend to the States but she had an issue with the authority before. She moved here to US back in 2005 when she was 9 years old. At age 16 she went with her friends to this abandon hospital. People around the area called a cop on them and they were arrested for transpassing the property. At a time this happened. She had a green card pending. She was told to stay in the country until the process is finished. But her mother decided to send her back to origin County (Indonesia). What's the best way to bring her back here? Thank you for your time beforehand! And have a great day! - Markus

Trespasing is not usually a big issue but if they told her to stay until it was resolved, you need to find out if there was a court date

if she missed that, it is important and will need to be addressed

Even the most minor offenses can haunt you later when a security check is done

this should be easy to check into and clear / do it and apply for her and the best to you both

She was a minor no record... Her mother went back as long as the were not removed or have a ban she should be fine.

As mentioned already, get in touch with her mom (assuming she is still here) and follow up on that court case to see the status. IF something has to be done to clear it up, you do so.

If you wait till she fails a background check, I don't know what option you have

I found this find out if her record is sealed

They dont consider petty offenses and anything over 5 years ago

Are you engaged and planning to marry? Then you can go for the K-1 visa.

She will not require a police certificate from the US. Just answer all the questions on the forms honestly.
