2016 125% Poverty Guideline

Hey all,

I apologize in advance since this may be a redundant question, but I couldn't seem to find a recent or clear answer in the forums.

For the rule about 125% of the poverty guideline, what is the minimum it takes? On my W-2 my total wages, tips, and other compensation totaled just over $23,200.

From what I googled, the 2015 federal poverty level for a household size of two was $15,930. 125% of this would be $19,912, so I would be in the clear, correct? I just want to make absolute sure that I will be okay for meeting this requirement. Self-doubt goes a long way when sending all this information off into the abyss, I guess!

This is the 2016 poverty guidelines, so you're still above the minimum.

Thank you so much!! I just got the letter from the NVC today about them receiving my petition and sending it on to the embassy, so now that we are so close I of course started to panic and question everything I had previously read. Thank you very much for your help!!

May I pose a twist on the income question?

Gross Income is derived from different sources.

Such as:

Regular Hours

Overtime Hours

Yearly Bonus

Holiday, Personal & Vacation Pay

No Income is guaranteed from one pay check to another. I am sponsoring 5 people. Without Overtime, I do not qualify for 100% of Poverty. With Overtime included I am $4,000 over the 125% Poverty Level.

Any comments would be appreciated.

You would need to supply some documentation of the overtime. If you list your current annual income as $4k over the required amount for your household size, then you need to provide letter from employer stating hourly rate, that it is full time, and that you regularly receive OT at time and a half, or whatever amount yours is. The letter could also state you always receive a yearly bonus and perhaps how much that is. OR, you can have the employer letter state your annual income amount that is equal to the amount you are listing on the form. Also supply pay stubs to show how much you regularly earn.

They will look at your earnings from line 22 on your recent 1040.

That is mostly for self-employed. Employees do not have to list their past income and can list their current annual income and provide letter from employer and/or recent pay stubs to document that amount. Documenting the income amount goes for other sources of income as well, such as retirement, child support, and other non-taxable incomes.
