Hello

I need guidance please

I recently did my spousal interview for USA

I used my income to meet the sponsorship requirements as I am intending to keep the same job I was way over the poverty guidelines with my husband's income and mine combined and added my assets to it but the officer kept on insisting on joint sponsorship finally someone agreed to joint sponsorship but he is self employed has emp Inc less than 20k but gave us his business return as well now question is can I use his individual return and business

Plus how do I fill out i864 with all of his information the information on the instructions is very misleading . previously I thought I followed instructions when I added my Inc to my sponsors to meet the income level

question 1 is very confusing on i864

do I put joint sponsors name and then fill out all of his info as I filled out i864 for my spouse and get the joint sponsor to sign the last page

do I still need to submit new form my husband?

Any guidance will help

The joint sponsor will fill out a separate I-864 and will not be adding their income to yours or your petitioner's. Because his personal income is below the threshold, he is a very poor choice to use as a joint sponsor. I highly suggest finding someone else. This isn't a work visa, you aren't being sponsored by a company.

Yes. I interviewed. It's really hard to find a joint sponsor ):

He does not have family here. One of his friend agreed. But his personal Inc is less than 20k but business Inc meets the guidelines. I waited for a year. Very frustrating experience

If someone drives a taxi as self employed. Can you use them as joint sponsor? Or it that also considered business income in states. I saw a section about self employment on i864.

my husband sponsored his parents before that's why he needs extra income.

Self employed is okay, it's different than owning a business and trying to use that business's income. A self employed person is contracted or pays themselves from their self owned business. They ARE the business.

He needs to make enough for his household and you. Under $20,000, he does not make enough.

You need to find a qualified Joint Sponsor. The person you have does not qualify.

I guess I'm curious. Did they give you a reason why they wanted joint-sponsor? Was your job just started? Are you saying you were keeping your job overseas UNTIL you move to the US, or would your job continue there also? There must be some reason they did not except the fact that you and your husband had enough income.

As for your joint sponsor. If he does not have enough income, he can add assets. If he owns the business the business is an asset. He would just have to prove that the business is worth enough to make his income shortfall. Possibly, showing business tax returns for a number of years could show worth, or the value of "tools of the trade".

I live across the border and I have a govt job in Canada which I m intending to keep.

I told the officer and he said it's not in US dollars

As far as joint sponsor we found someone who drives a taxi and used his 1140S tax return

I think you mean his 1120s form. That is a S corp tax form. You can't "OWN" an S corp. You CAN be the only stock holder, officer, and employee. The form will show what was paid to him as a stock holder and money paid to him as an officer, employee, but that would already be shown on his 1040. If the taxi is in the company name, he doesn't own that either.

I don't understand about income. Many are paid in foreign currency, but you have to state on the forms the amount in US dollars. The official government rate are here

Hello Visa Journey member: Can a person that is going through the same process (CR1) be a Joint Sponsor. They are over the age of 18yrs., Lives  & works in the US also is well over in income level as well.
Can she be our Joint Sponsor?

A Joint Sponsor must be a USC or LPR.  Someone currently going through the immigration process does not qualify.  That person must be an LPR first before becoming eligible to be a JS.

Can I just ask out of interest, what was the outcome of your interview then? Did they hold onto your passport and then say fax or mail the affidavit form? How did it all work? What's the process now for you?
