BRINGING MOM AND DAD TO US!!!...but need to know if I should file before they come on Dec....

Good morning all:

Last time I used this site was when was in the process of getting my K1. Now I am a citizen and about to start working on my parents paperwork to come and live with me in NY.

Question#1: They are coming to spend christmas with us and will stay until Feb 20th (or so). Should I send paperwork now or should I wait till March 2017.

Question#2: What do I send? Only paperwork that says on website for uscis,gov ...which means I-130 plus fee and documentation needed such:

mother lives outside the United States,

  • Form I-130
  • A copy of your birth certificate showing your name and your mothers name
  • A copy of your Certificate of Naturalization or U.S. passport if you were not born in the United States
father lives outside the United States,
  • Form I-130
  • A copy of your birth certificate showing your name and the names of both parents
  • A copy of your Certificate of Naturalization or Citizenship or U.S. passport if you were not born in the United States
  • A copy of your parents civil marriage certificate

I don't know which country they are in but if it was Ghana, they will be rejected so easily. I will say wait till March. Why will they return back if there is a petition for them to migrate?

Hi Caykay1,

They are just coming to visit us. We are from Peru in South America. They don't have any intentions to stay until paperwork which I want to start is approved. Like I said before, they are coming and going back home and will be taking care of this whole process from home.

Of course they can come for a visit while the I-130 forms are being processed. Make sure they bring with them strong evidence that the visit to you over Christmas is indeed only temporary, and that they do have enough binding ties to Peru that they intend to return home.

I actually think you should wait. Although it is possible for them to enter the US on a tourist visa after you file the petition I-130, the officers at the entry can deny them permission to enter the US based on intention of immigrating to the country. I personally wouldn't risk.

Lots of people visit while the process is ongoing. Keep visits short, being proof of ties to your home country, be truthful about your visit but dont volunteer extraneous information.
