Hello fellow VJers!

I just would like to ask the success rate of having my husband's visa approve under this circumstance:

I am currently unemployed since I just graduated from college in the Philippines and I went back here in the states to review for my state board examination (NCLEX). While I am reviewing, I decided to send the I- 130 together with all other required documents, since I know it would take some time for my petition to be approved. Would the embassy consider my parents as my joint sponsor? My father's income is good for 5 household and I am the only child. Or would it be better if I find a job first before filing for an I- 130. I'm just curious on how our petition's outcome would be. I'm really looking forward for my husband's petition to be approved in the Philippines.

Your parents can be Joint Sponsors for your spouse.

Thank you aaron2020! :) But would there be a greater chance of approval in the Philippines embassy during the interview of my husband even if I am jobless? I just do not want to spend too much then at the end get a denied visa.

You will be fine with your parents as cosponsors if it comes to that.

However, I assume you are planning of finding a job soon? There will be some months after filing before you need to supply the affidavits of support - plenty of time to secure a job.

If it isn't difficult, it isn't worth it.

You will be fine with your parents as cosponsors if it comes to that.

However, I assume you are planning of finding a job soon? There will be some months after filing before you need to supply the affidavits of support - plenty of time to secure a job.

Yes i am planning to work as a nurse in a hospital as soon as i pass the state board exam. I'm just a little bit worried if ever I wouldn't be able to pass yet when the affidavit of support is needed.

It doesn't matter if you are jobless when you have a qualified Joint Sponsor. Plenty of people who don't work have gotten visas for their spouses with a qualified Joint Sponsor.

As long as your parents live in US and are either US citizens, LPR's or naturalized they can be your joint sponsor. Matters not your job situation.

It will be a few months before your financials are needed when you get to NVC. Just as long as your parents fled taxes last 3 years or show reason why they weren't required to. They only have to qualify for a Household size of 3.

What everyone else has said, is very true.

My spouse (USC) does not work (currently with me in Canada, helping me get ready to move to the US). She hasn't worked since the end of 2013.

My spouse filed an I-864, and my Mom and Step-Dad filed I-864 and I-864a (respectfully).

There were no issues at all.

I would say attach a letter explaining why you're unemployed. I believe you're reviewing for the board exam to be a nurse and when you find a job, you both should be good. I guess you should be fine

Thank you so much caykay1! :) I already attach a letter explaining why we are both unemployed. And yes, we are both reviewing for our state board exam and also planning to take it months from now. I just hope everything would go according to what is planned. So that once pass the NCLEX and work as a nurse, there's no big problem at all.

When i got to the NVC stage I applied for NCLEX. and reviewing... somewhat.

While you are waiting for the USCIS to approve you I recommend you get your IV and especially your AOS ready.

You fill out an I-184 and your family willing to co-sponsor. Also have them fill out an I-864A.

Thank you so much caykay1! :) I already attach a letter explaining why we are both unemployed. And yes, we are both reviewing for our state board exam and also planning to take it months from now. I just hope everything would go according to what is planned. So that once pass the NCLEX and work as a nurse, there's no big problem at all.

I feel like I posted this a long time ago and forgot ever made this thread.... My husband in the Philippines passed his NCLEX back in April!!

When i got to the NVC stage I applied for NCLEX. and reviewing... somewhat.

While you are waiting for the USCIS to approve you I recommend you get your IV and especially your AOS ready.

You fill out an I-184 and your family willing to co-sponsor. Also have them fill out an I-864A.

Same with our case, we graduated last year and took the local board and started reviewing for the nclex. I just hope we could make it, in passing the NCLEX so that everything would run smoothly. Were there no other questions with regards to your petition knowing you don't have work? Thank you!
