Hello,

I am filing for my husband who is currently attending college in India.

We have already submitted I-130 to USCIS and it has been approved.

NVC has contacted us and we are working on DS-260 and I-864 and the other supporting documents.

He will not be graduating until May 2017. He wants to finish his degree before he comes to the u.s.

Now, the I-130 took a while to be approved (about 5 months). According to the NVC website, it will take about 2-4 weeks for then to process and forward our case to the Embassy in mumbai. Then, the embassy will process and contact my husband for interview date. Upon having a successful interview, he will then be issued a visa. And that visa will have an expiration date indicating by when he must make his entry into the U.S....visas usually give maximum 6 months to make entry into the U.s

I understand that we can request the interview date to happen at a later time, however, NVC informed us that we do not know when we will be rescheduled. It could be a week later, it can be a few months later. Depends on the embassy schedule.

That being said, we do not want to request the interview date to happen later.

I've contacted NVC about this, they told me I can submit the documents later, therefore the interview will happen later. It will be fine as long as we keep in contact with them every 1 year.

But I want to know if it is possible that if lets say, he gets an interview date June 20th. And it's approved. He will have a maximum time until December 20th to enter the U.S. this is too early as his graduation is in May 2017.

Instead if his interview date is still June 20th. And it's approved, can he request them to not issue the visa until December 20th. This way, the expiration will be June 2017. Giving him an entire month after completing his college to enter the u.s....

In regards to being able to request the visa not be issued immediately after the interview and at a later date instead, the NVC said to contact the embassy. The guy at the embassy unfortunately could not answer my question. I don't think he understood my situation. He said to just email the inquiry instead. I did aND am waiting for a reply from them.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

Oh dang! The medical is only valid for 6 months?!...okay I guess our only option is to delay in submitting DS 26/affidavit of support...

Yes this is the best option. Just don't send in your documents because you can't stop the progress after you get case complete. You have a year from last contact so this time next year you can start Or start around February get case complete probably would get a June interview than you can immigrate.
