Requirements for DCF

Hi!

My fiancée and I are considering getting married in Europe and then applying for a CR-1 visa for

her (I am a U.S. citizen, she is a Canadian citizen) through the embassy in Frankfurt (I am also

a German citizen and resident). I have three questions regarding this process:

1. Do I have to remain a resident of Germany after filing the I130 petition in Frankfurt?

Is it enough to have a mailing address in Germany while already moving to the U.S.?

I will be accepting a job there soon.

2. How do you prove your marriage is bonafide shortly after getting married? We have plenty

of proof that we are in a real relationship (over 3 years now, lots of joint travel receipts, pictures

with each other's families, friends willing to sign affidavits) but it is hard to prove our marriage

is bonafide since it will take place shortly before the application. We have been engaged since

late last year and have an engagement ring and photos, would that help? Facebook chat

transcripts?

3. The way I understand it, you file the I130 petition by mail with the embassy. Is that correct?

1. No, you can leave as soon as the I-130 is filed. Many elect to stay until the I-130 is approved, just in case the initial filing gets denied for some paperwork reason.

2. Bonafide relationship is important. Do you live together? That is the big thing, if you an prove that you should be fine.

3. Usually yes, together with supporting documents. Exact policies are different at each embassy.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you for the fast reply!

We have lived together before for multiple multi-month stretches.

Currently we are not living together however since I am in Germany

and she is in Canada for a post-graduate course.

I have visited her in Canada twice, and she lived in Germany for a total

of two years, most of which we spent together. We have both moved around alot

for school and work.

No, not currently. She was a resident though, and the embassy does not specify that the spouse has to be a resident

when filing the petition.

And the medical? She would have to have that done in Germany too right? I've never come across a DCF where the spouse lived in another country that's why I'm curious. So technically none of you would live in Germany once you filed the I-130?

Yes exactly. That should basically be possible though right?
This just seems like by far the fastest option, or am I wrong?
I have been reading a lot of immigration options and am frankly

a bit shocked at the wait times. Especially since I am sure the

applications are just on a pile somewhere and this is not because

of any security concerns at all.

I mean I always thought it depended on where the beneficiary lived so my spontaneous thought is that she'd do it all in Canada...but like I said I've never seen th scenario so I'm curious.

Just remember she might be stuck in Germany for a while after the interview waiting for the visa.

Other than the extra importance of proving that you two are in a bonafide relationship, as Penguin says, as a US Citizen resident in another country, you'll need to gather evidence to show you either have a USA residence of intent to re-establish one for completion of the I-864. Google for the instruction PDF for that form and take a read.

16th July 2013 - Interview (approved)

1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:

Time wise, yeah DCF is fast 3-6 months. Cr1 is usually about a year give or take a few months.

Ah ok good to know. Well I have an offer from an American employer so I assume that should suffice?

And really, she would have to wait in Germany? She couldn't just return to Canada? That's a good point,

hadn't considered that.

I dunno about having to be in Germany the whole time, but flying back and forth seems expensive.
