regarding i-864 and tax returns

Hi! My hubby and I just filed i-130 at USEM in Manila. So while we're waiting for anything, I don't wanna waste time and want to prepare everything I can (documents and stuff) before we get to the next step. I've been researching and reading up posts here in VJ and I could use some help with some parts of the i-864 form..

My husband and I have been living together for 2 years now though we just got married last month. He was in the army for 6 years before he left and decided to go to the Philippines, where we eventually met So he has not been filing any tax returns, and only has money saved in his bank account, his pension from the army and school allowance from the army as well since he enrolled in an online school to get a degree. My question is, does he have to write a letter or anything regarding his non-filing of tax? Is there anything else we could do to ascertain he can support me financially despite currently not having a job and just getting military pension? I hope this does not weaken our petition or cause a delay, worse, denial of the visa... Hope you can help me guys. Thanks!

US citizens are normally required to file taxes even when living abroad- if his income from the GI bill (?) is untaxable, can can jsut write a sentence or two explaining that though.

How much IS his income> He will need to make enough- taxable or no- to support his household when you guys move back to the USA. So that is at least a household of two, you and him, possibly more if you have kids or he has other dependents.

Yes his income is from the GI bill.. and military pension.

Is there a format or sample letter for that on explaining why his income is not taxable? If he is making enough as required for a household size of 2, would that be enough and tax returns won't matter anymore?

Format is not necessary but there are lots of sample letter here in VJ though..

If you're fearing about financial capacity I suggest that you get a joint sponsor.

Thanks sis. We'll try to prepare a letter of explanation.. does it have to be notarized?

Also, did you have to write a cover letter for i-130 and for i-864? and once confirmed do you just bring i-864 and other requirements with you to the interview or do you submit it separately at the embassy?

The letter of explanation doesn't have to be notarized and you don't need a cover letter. You just bring then with you to the interview with the rest of the documents.

I remember when I had my interview, they only asked for the NSO certificates (BC,MC,Cemar) and the I-864s of my husband with letter of explanation and our joint sponsor.

As stated above his income will still need to meet the poverty guideline as defined by Immigration's I-864p.

1040, W2's and all other forms and papers you used when you filed the taxes OR tax transcripts that can easily be requested online

do you print all pages of 1040? coz from 2013 alone we have like 90 pages of it...

Don't you have the 2013 tax transcripts? If no, then yes you'd have to print everything but it's not really required.

What they'll be needing from you or the joint sponsor is the 2015 tax return.

We got 2013, 2014 and 2015 1040s from our joint sponsor. But yeah, I'll ask about the tax transcripts. Do they still ask for the W2s?
