Timeline

I have a question regarding the income requirements and affidavit of support. We are waiting for our NOA2 after filing on march 3rd. I can meet the 125% income requirement this current tax year. However I was not required to file taxes previous years because of low income. Would it be best to also provide an affidavit of support as a back up, or would this not be necessary?

Well you will have to provide an affidavit of support from the petitioner regardless.

You can just use 2015 IRS tax Transcript and that will be fine. You don't have to send past 3 years that's just optional

For London, you can just provide the I-134 and your most recent tax return. You can also just provide proof of your current annual income with a letter from employer and/or pay stubs.

Just so you know, when you will be filing for AOS later and need the I-864, it will still be based on your current annual income. You list the info from the last 3 years of taxes where it asks on the form, and provide the most recent one, but that is separate from listing your current annual income, which is most important.

Correct answer is post #3. London does not actually require seeing a tax return or transcript with the I-134 if you can prove the income another way. Employer letters seem to be a favorite with them.

Thank you so much, this is very helpful! I think in this case the tax return will be best, because 80% of my income is tips and the return will allow me to show that.
