I tried to research the I-130 and I-129f topic but apparently i didn't research enough. I sent in an I-130 for my wife (who also has a daughter) and as soon as the NOA came in i sent out the I-129f K3 K4 and got the NOA for that today. Now as i read more of the threads in these forums i have discovered that the I-129f will most likely be dropped . Both of our petitions have been forwarded to Nebraska and most likely will be processed together. I now realize that i need to send an I-130 for my stepdaughter ASAP. My concern is that the two petitions will be processed at different times . Leaving our daughter to wait for a separate interview is not an option ( she is only nine years old) . Any advise would be greatly appreciated .

When submitting your daughters request a expedite and ask the cases be married up. If they don't there is much you can do to wait for daughters petition.

Just wait. This is what you do

1. Wife's petition arrives at NVC

2. You get Case# and IIN - Do nothing

3. Daughters petition gets to NVC

4. Call NVC and request cases get married up

5. They get married up you have just 1 AOS fee of $120 (YAY)

6. Now they are married up you can submit DS-261 and pay the AOS fee

7. Send in AOS and IV packages

8. Pay the IV fee $325 for both

9. Submit DS-260 for both

They will be scheduled together. Cases are married up. :goofy:

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just to let you know...

I sent all of our I-30 together and my kids got approved and I didn´t...

So, this is like a "box of chocolat" - you never know what you will get...

Also I would have a copy of your I-797C (NOA1) notice and in your cover letter mention your wife's case and receipt # and request your daughters petition to be married up to your wife's. Once you get your daughters receipt number follow up at USCIS with a call that they are together.

Soooo called Uscis customer service this morning and they said " its not a problem " as long as i listed my stepdaughter on my wifes I-130. I tried to explain what i have read about the process and she said daughter doesnt need her own I-130 at this time to get here with her mom . This does not sound correct to me

Unless you are a LPR(Legal Permanent Resident) you can put on same. They are deriatives.

US citizens can't do it each immigrants has to have their own I-130.

And do not talk to a operator ask for a tier 2 supervisor if you call USCIS.

The CSR was wrong and this is why on VJ we call the USCIS phone line "the misinformation line." They haven't a clue and often even if you talk to a tier 2, you should do it several times and take the most often given answer. I swear the call center employees for such an important government program are trained worse than most!


Trust us when we say we know what will happen here without an I-130 for a child. It's happened a lot on here, and then there are tears, and anxiety, and anger... Oh just send the I-130 for the child. :D

That,s exactly why we joined VJ . Makes me wonder though if the USCIS agents do not know what we are supposed to do how do they expect us to know how to get through this process? I just want to thank everyone here for the guidance it is greatly appreciated :)

Concerning this I-130 for my step daughter , we will need a G-325a for her but should she be the one to sign it as she is only nine years old or does her mom or me sign it? i looked for info on this but couldnt find it anywhere

Children don't need the G325A. You only need to include their birth certificates with their petition.
