so i'm filing for a K-1 visa for my fiancé in the Philippines, she has 3 children. Her children will of course go with her. The problem is on the childrens birth certificate, it says the civil statues of parents is married in Bahrain. They were NEVER married in the Philippines or Bahrain. She told me they just had to put that on the registration for birth certificate for the kids baptism & school. How is that going to affect my petition? And how will that affect the children's visas?

Well the birth certificates won't be sent in with the I-129F you only have to write their names on the application so it won't effect the application.

The problem might be at the interview K-1/K-2 since they have to shown in English there.

Does she have any proof of never being married?

Does the bio. father allow her to take the kids to america?

The birth certificates are in English, its says married in Bahrain & theres a date but they were not married.

She has a Cenomar already as proof of no marriages. The father doesn't have a problem with the kids coming here.

We tried researching how to get that removed but it takes a court order, 6 months to a year, & a lot of money.

Will that be a problem when she goes for the interview?

Well then bring that Cenomar and a statement from the father stating that he allow the kids to permanently immigrate to USA.

And you may what to ask in the Philippines forum as they may know more since it that embassy :)

Your fiancee's CENOMAR will not prove that she's not married. Many Filipinos get married outside of the Philippines and never report their marriage. Therefore, the PSA will not have a record of those marriages. When the embassy notices that her children's birth certificates show that she's married, her visa will be denied.

Your best bet is to bite the bullet and get the birth certificates corrected.

Of course, if her children were to follow to join, that might be a different story, but It may have consequences down the road.

I believe so. As the OP mentioned, it's a court procedure. And in the Philippines, that means a lot of time and money.
