EAD Approved (not received) No Biometrics Appointment?

I'm here on a K1 visa and filed for AOS/EAD/AP in November and was given a receipt notice dated November 19.

I recieved I-797 Notice of Action saying my EAD and AP was approved (dated Feb 2) but I haven't received a letter for a biometrics appointment. I called USCIS last week and the gentleman put in what I think he called a service request to inquire about my case and why I haven't received the appointment yet. I haven't heard anything back from that yet.

My question is, how is it possible the EAD was approved without a biometrics appointment? Was it just approved but won't be issued until the appointment? I've been eagerly checking my mail daily because I really want to get a job.

Thanks in advance.

I was under the impression the biometrics is needed before the EAD/AP too, I have no idea why you have not received an appointment.

Just thought I'd post a follow up.

I made an Info pass appointment for yesterday (Feb 22) and made the hour drive to the field office and was basically told to be patient. The gentleman who helped me had my case up and said that they hadn't even sent an appointment letter out to me yet and there isn't really any timeline they abide to. He said as an example there was a man who comes in now and then who had been waiting 10 years... Furthermore he told me that all they have access to is what we have access to on the USCIS website (check case status) and there wasn't anything he could do. Also that calling USCIS and getting the service request really didn't do anything, that it was for "impatient people to make them quiet for a while" because all they basically do is print out the case status and mail it to you. It was a bit of a sour interaction but the guy wasn't particularly rude.

Then today I get my biometrics appointment in the mail (for an appointment next week). Maybe a coincidence, maybe going out there and bothering them in person made them do something. The fact that he said they hadn't sent the letter out when I got there (10am appointment) and that I got the letter 24 hours later makes me think a bit.

Who knows.

Still bizarre that you were approved ( or is it a fluke ?) before the biometrics.

Yeah agreed. When I showed the guy my approval letter he said "That's for your employment not your green card" and I replied "yes I know but isn't it strange that..." and he kinda talked over me and said something along the lines of that it has nothing to do with the green card, and I guess nothing to do with the biometrics?

You are the first post I read where the EAD came before the biometrics. The guy sounded like he didn't know what he was talking about either.

I read your topic carefully. It is really strange, and I believe what you have passed.

. I am in the same situation, even with diferent type of problem. My online status was first receive, than change to Aproved, and now.... The Stranger Things come with: APPOINTMENT NOTICE MAILED TO YOU.

And this is for EAD & AP , not for AOS. ????

Even that the case is approved I still dont have the card on hand. ( in contrary, the documents went smoth for my san, who has hos card at home now. In fact we are not going to put him working. He is 16, goes to high school :) and have COMBO CARD IN HANDS. I feel to cry and laugh at the same time.

TOMORROW I have an infopass appointment. I know I am not getting a lot there, but at list I will have a prove in case they pretend that I miss an appointment

Don't wanna rain on your parade, but approval is almost impossible cause of 2 reasons:

1: They CAN'T approve your EAD/AP without your biometrics, since that's your background check.

2: They're working on September cases right now. The only way a November case would be approved is if you expedited it.

You could call USCIS to get this figured out, it seems like they approved you by accident or sent the I-797 by accident. If they did actually approve you, it could hurt your EAD/AP if they find out you didn't do biometrics yet.

95 days is not that long at all. Currently processing time for EAD/AP is 4-6 months, where most people (including myself) get approved after 150-160 days, aka about 5 months. Calling them before you're outside the normal processing time is not going to do anything. Immigration is a long road, but it's worth it :)
