Hello dear VJ community!


Currently we are married for a month already, but have been together for 7 years. We live in a same country, and want to apply for CR-1 visa and move to the US.


So there are couple of questions.


I've never worked in the US, and never filed US Taxes, however I have a US home adress. So what will be the best option for us? I am going to move alone at the end of may, until the visa process is over. Should we


1) Apply for CR-1 now, until I move. We want to do that, because the process takes longer in this country.


2) Wait until I move, find a job, and rent a house, and then apply for visa?


3) Can I count my income, If Im just going start working ? We are going to find joint sponsor whatsoever.




That's it for now, any advice will be appreciated!

April 1 2016 - Sent CR1 package to RapidVisa.

April 18 2016 - CR1 Package delivered to USCIS Phoenix lock box.

April 22 2016 - Acceptance notification received by email. Case sent to Nebraska Service Center.

May 03 2016 - NOA1 hard copy received.

May 24 2016 - Return to the US to reestablish domicile.

August 3 2016 - Case transferred to Texas Service Center.

August 29 2016 - I-130 approved! (NOA2) <3 <3 <3

September 30 2016 - NVC Recieved.
November 14 2016 - Sent AOS and IV packages to Rapidvisa! :D
November 29 2016 - SCAN DATE!
February 15 2017 - Case Complete at NVC (11 weeks)
March 28 2017 - My Interview Day! :D (APPROVED!!!)

1 and 3 would be my vote.

So you have never had to file taxes or you just have not filed taxes?

No, I haven't work officialy yet.

So is it OK, to apply now, when I don't have any work and place to live in the US? So what about Tax Transcripts, at what stage I will need them?

The US taxes on worldwide income. So while you may not have to pay taxes, you may have needed to file an income tax return. You will need to sort this out for the affidavit of support.

Are you a US citizen? Re-reading your first post, I couldn't work out if you are a returning citizen or a new immigrant when you wrote about "moving to the US".

You need to be a citizen or permanent resident before you can petition for a CR-1 for your spouse. Sorry if I've misunderstood that.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Yes, of course I am a US citizen, however I've lived there until 11 years old, and I am 26 now.

Okay so the most important question for now is

Can I file petition now, if I don't live in USA, and don't have a job? Should I write in petition my local adress or my adress in the US?
