Hi guys,

I am a dual citizen of Australia and France currently working in the US on an E3 work visa (similar to H1B but for Australians only.) I am getting married to my USC fiancé soon and planning on filing for AoS.

Which citizenship should I put on my AoS application forms (eg on form G-325A)? I am inclined to put "Australian" because my current visa is in my Australian passport and I would not need to get my birth certificate translated. But I have also in the past had a US work visa in my French passport.

Should I just pick one? Should I attach an additional sheet explaining my dual citizenship?

Would love to hear from anyone with a similar experience.

I would let them know of both. It's generally better to put all your cards on the table, so to speak.

I don't have an answer but I will mention that the green card lists your country of birth. For consistency purposes, you may wish to use that (assuming you were born in one of the two countries of your nationalities). Where were you born?

And on your most recent entry to the U.S., what passport did you use? There may possibly be some rule about adjusting status only from whatever nationality you used for your current stay in U.S., though I'm just speculating at this point.

Thanks for your input, guys. I was born in Australia and entered on my Australian passport last time, so I guess it would be most logical to go that way. Now I just need to hunt down my Australian birth certificate :-P

I would suggest to use the nationality of the country you are born in.

USCIS Seem to give more importance to your place of birth than other nationality you may have, even if you are a dualcitizen.

What makes me think that is the registering system in place for the DV lottery each year. Applicants are registered using the nationality of there place of birth. You cannot use another nationality even if you have it.

I would suggest that you use your Australian nationality for the Aos.

Thanks for your help, everyone! Choosing to go with "Australian" on the forms but include a copy of my French passport (including the page containing the old US visa it it) just to make sure I'm being thorough.
