Hey guys,

I was wondering if anyone had any help or advice for my fairly complex situation. I'll start from the beginning....

I am a UK citizen who has been living in australia for the last 3.5 years. I got married about 2 years ago to a USC, in the US. She has been living with me in Australia.

We started the visa application about a month after we got married and are at the stage where we are waiting on the DS260 (completed on 6/12) getting approved for an interview date. I spoke to to the NVC today and was informed that as it had went past the 45 day time period they would get on that asap. The problem is we are currently in scotland with no intentions of going back to australia.

I emailed the NVC on 12th december requesting a change in interview venue as I wanted to get that changed before I received a date in sydney. I hadn't heard anything so I called them on January 20th and spoke to a woman who informed me that my DS260 was due to be looked at by the 24th and that to request a interview venue change I would need to attach a supporting document to prove my eligibility (my passport). I sent this email that day.

So after the 24th passing I waited a few days before calling to check up. That brings me to today. I have just spoken to someone at the NVC who brought my DS260 to the atention of her supervisor and then informed me that it would take 45 days to process my email for the interview change. She also told me that I could email requesting an expedite. The reason for this is that my partner is in the UK with me on a holiday visa and by the sounds of it she is going to go back to the US alone as I can't see my visa being approved before her visa here runs out (roughly 2 months).

So what I'm basically asking is:

Is there anything else I can do to solve this problem and make the process go a bit quicker?

Is my reason for an expedite a good enough reason, if so what documents would I need to attach?

Even tho my original email sent on the 12th december (requesting an interview change)didn't have an attachment providing proof of eligibility, would it have a chance of being approved? (I have had no response from it as of yet)

Sorry for such a long jumbled post, I'm just trying to provide as much info as possible. Thanks for any help in advance.

regards

Martin

You can look up the reasons for an expedite, spouse being on a holiday visa is not one of them.

There is also the Domicile issue, I would start by reading the guides on VJ.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

The situation isn't complex at all. You moved and requested a change of "venue." Transferring the file typically adds time to the process.

The reason for the expidite isn't compelling. (Lonliness? Time apart?)

go ahead and ask. It doesn't slow down the process to make the request.
