Hi guys,

My husband (USC) has moved back to the States after our case was approved by USCIS and before we filed any documents with NVC. Before that we resided together abroad.

My understanding is that it is our responsibility to inform USCIS of the change of his address, which I should be able to do online.

I went to USCIS website and tried to fill out an electronic form at https://egov.uscis.gov/coa/addressChange.do

The problem is the form only allows you to put an American address as the "old address" - you have to choose a state from a list, otherwise the form won't be submitted. It doesn't give you the option of choosing a foreign country where the previous old address was.

What should we do in this situation? I understand we still need to inform USCIS of the change of address even though our case is already approved and currently at NVC, is this correct?

No. Call the NVC and submit his change of address there. After the I-130 approval USCIS are no longer part of the process and are not the agency you should be contacting.

You can choose to file a paper form I-865

I-865, Sponsor's Notice of Change of Address

F & J, thank you for you reply, but the instructions for the form I-865 specifically say "If at any time in the past you completed Form I-864, Affidavit of Support, to sponsor an immigrant, you are required to report your change of address within 30 days of the change if the sponsorship agreement is still in force.".

Since we have just paid our fees but haven't completed the I-864, I understand that we do not need to file form I-864.

Ryan H, thank you for your reply, I thought that that's what we would do - just put the current address on all the forms that we send to NVC. But this means that the USCIS will technically never be informed of the change of address. Is this OK?

Oh, in that case, no, you don't need to file the I-865!

Ryan H is right - just use your new address on any new forms you will be filing in the future :)
